The next step for 60-year-old Johnny Irby is to head to trial for the murder charge connected to the death of his son.

Irby was charged with murder and attempted murder after he fatally shot his son and his son’s fiancée during a dispute over his son moving from their Moncks Corner home, police have said.

After a preliminary hearing Friday in Moncks Corner, a judge bound the case over to trial despite the defense’s claims that it was a case of castle doctrine, a person’s right to defend themselves from intruders in their home, Moncks Corner Police Lt. Michael Roach said.

Irby’s son, 35-year-old Telly Jovan Irby, died from a gunshot wound to the chest on Aug. 17, coroner’s officials have said. Telly Irby’s fiancée, 32-year-old Michelle Wiggins, also was shot in the chest, but she survived, according to authorities.
