Riding a bicycle in the dark without a headlight can cost you more than a ticket in North Charleston. It can cost a night in jail.

Shortly after 10 p.m. Monday, a North Charleston police officer saw a man pedaling a bicycle with no headlight through the intersection of Spruill and Buist avenues.

The officer had to swerve to avoid hitting the bike, according to a police report.

The officer tried to stop the cyclist, but he kept pedaling, talking on a cell phone.

The cyclist eventually pulled over and the officer arrested him.

The bicycle was turned over to a friend before he was jailed, the report said.

Labyrant Harris Mack, 28, of North Charleston was taken to the Charleston County jail.

He was charged with "failure to stay right on a bicycle and no head lamp," the police report said.

Mack was released on Tuesday, according to jail records.

Asked about the propriety of jailing a person for not having a bike lamp, police spokesman Spencer Pryor said riding a bicycle in the dark without a head lamp is a violation of city ordinances.

"The officer had to swerve to avoid hitting him," Pryor said.

"Maybe he wanted to show him just how serious the offense is."
