Key vote to revamp SPA set for today

COLUMBIA - The State Ports Authority is one vote away from a significant overhaul that South Carolina legislators pushing for the change said is necessary to restore the shipping industry's confidence in the Charleston port.

Tangled up in the bill is a provision that addresses critical access for the region's two major rail carriers, and that is at the center of a boiling feud with North Charleston Mayor Keith Summey.

Summey has threatened to take legislators to court if the rail provision makes it into law. The provision originally ordered that ownership of a rail line and right of way at the north end of the former Charleston Naval Base be transferred to a state entity.

North Charleston officials have taken the stance that the measure was designed to open the north end of the former Navy shipyard to rail lines capable of serving cargo from a new port terminal at the south end, despite an agreement that prohibits access from the revitalized northern end of the old base.

On Wednesday, Sen. Larry Grooms, R-Bonneau, led an effort to scale back the rail access provision. The Senate amended the bill and sent it to the House with new wording that essentially pushes off the access issue until a pending court case on the matter is settled.

The House is expected to vote today to send the bill to Gov. Mark Sanford for consideration or force it into conference negotiations.

Rep. Jim Merrill, R-Daniel Island, said he believes the new rail access provision puts legislative leaders in the position to work with North Charleston to make sure CSX and Norfolk Southern have access to the port.

He said the vast majority of Upstate companies do business with Norfolk Southern, but CSX is the rail line that currently has the best path of access to the port.

Some lawmakers said dual access is necessary to keep the port price competitive. "Unless we intervene, it is not going to happen," Merrill said.

He persuaded the House to uphold Sanford's veto on a budget item that also dealt with rail access. Sanford's veto was based on the idea of free negotiations between the parties involved without legislative directive dictating the process.

Merrill disagreed with Sanford's reasoning and called much of his veto message false, but Merrill said the issue needed to be dealt with in the port restructuring bill, not the state budget.

The bulk of the restructuring bill addresses the makeup of the port authority's governing board, including qualifications and education and experience standards for the board members.

The legislation also calls on the port to sell land it owns on Daniel Island and in the town of Port Royal, among other measures.

The big picture shouldn't be lost in the rail access fight, Merrill said.

Charleston-area leaders decided to intervene in port affairs after some lawmakers began to feel that the port authority was more interested in making a profit than it was in serving as an economic driver for the state.

In recent months, the port's biggest client announced it was leaving and the authority's Chief Executive Officer Bernie Groseclose abruptly resigned.

...and Jim Merrill is still doing whatever he can to preserve his kickback from Norfolk Southern, I wonder how much it is? Here is a simple solution that will NOT get any extra cash in Merrill's pocket - No rail through the North end, make NS and CSX play together as they do in Savannah and Norfolk and do not destroy the North end of the Navy base and all of the progress that has happened there and around it. There is an excellent plan being proposed by local leaders which accomplishes this and does not trash millions of dollars in property value, ruin neighborhoods and dismantle all of the hard work that people have put in based on the State's agreement to NOT RUN RAIL THROUGH THE NORTH END OF THE NAVY BASE!

Merrill is rediculous. He is only doing this because Daniel Island is not off the table yet (until the land is sold that the Port was going to be on). Still there doing nothing.

He is under pressure from Upstate legislators whom represent the area where BMW is. BMW is already starting to shift ops to Brunswick for their imports along with Vehicle processing centers and jobs.

Merrill is pushing this so hard because he doesn't want it on Daniel Island.

Unfortunatly for him, if Summey sues, which he will... It will tie up the opening of the Navy Base port thus shifting the focus back to Merrills precious Stepford where there are already plaanned rail right of ways, the SPA still owns land, and has built reinforced interchanges.

Daniel Island residents should be telling Merril to drop this crusade as it will only end up hurting Daniel Island in the end.

Run the rail through the South end, Have NS and CSX cross lines, and everyone will be happy.

Think about it - The sooner the lawsuit the sooner we get to see "Global gateway revisited".

Rep. Merrill - It's a shame what happens when you don't play nice... or honest.

JAS - good point. The sad thing is that NC is more than willing to have the port, we just want to have some say in how it will impact our community, especially since that say was given to us when we began making tremendous investments in redeveloping it.

NO ONE IN NORTH CHARLESTON IS AGAINST RAIL ACCESS TO THE PORT. IT IS ALREADY PLANNED FOR THE SOUTH!!!

Do people seriously think North Charleston wants that many more trucks on the road? NO!

I actually work in the Port Industry. I Was well aware of the Port EIS and the Navy base terminal when making an investment in Park Circle.

I don't mind the current amount of rail traffic in our community. It adds character, there's always a way to get around it, and it keeps people like Jim Merrill and the Stepford Wives out.

The Port expansion will spur many good middle class jobs not necessarily with the port itself, but with NVO's, Freight Forwarders, Distribution centers, etc. that are only here because of the port. Jobs like mine that has given me and others in the neighborhood the ability to invest and renovate a home in Park Circle.

I studied the Port EIS in college. It took years of hardwork to draft and finalize, it is truly an excellent plan and it fulfills the needs of everyone involved. From Shipper's to resident's to Both rail companies.

This Northern rail charge that Merril is on is a knee jerk reaction to BMW's threats so He can protect himself. It is really symbolic as the first paragraph of the article suggests.
Merrill does not know the meaning of compromise and it may very well backfire on him and his DI constituants.

He better get the SPA to sell that land across the river quick. Unfortunatly for him, the SPA is not in a hurry.
