Legislature has 3 days left to pass port overhaul bill

COLUMBIA — North Charleston Mayor Keith Summey is prepared to take lawmakers to court if they send an edict that would cause more railroads to run through his city, and he is planning to rally as many as 500 people to Park Circle tonight in protest.

In the session's three remaining days, the Legislature is expected to pass a law to overhaul the governance at the State Ports Authority. The bill, as it's drafted now, also includes a provision that is intended to open up access to the region's two major rail carriers by transferring ownership of a rail line and right of way at the north end of the former Charleston Naval Base.

Summey on Monday repeated his comments that a protracted legal fight would ensue if the Legislature puts that provision into law.

"The city of North Charleston is in this for the marathon," he said. "We're not going to bow down and play like we're the lackey boy."

Ask anyone: The issue carries high stakes for South Carolina's future economic prosperity.

Legislative leaders decided to intervene in affairs when that port's biggest client, Maersk Line, announced that it would do its shipping elsewhere. Shortly afterward, in January, SPA's Chief Executive Officer Bernie Grosecloseclose abruptly resigned. Both developments followed reports that cargo declined by nearly 10 percent last summer. At the same time, business in Savannah was up by an amount about equal to Charleston's loss.

Rep. Jim Merrill, a Daniel Island Republican and former House majority leader, is one of the lawmakers pushing for the legislation to pass.

The rally will be at Felix C. Davis Community Center at Park Circle, 4800 Park Circle in North Charleston.

"The port is one of the two or three top economic engines in our state," he said. "We've seen a very much disjointed approach to how the port interacts with our businesses, our local communities and our other state economic institutions. We have a window of time when we can fix this."

Merrill said the provision that deals with rail access pertains to a rail line that already is in place and still is used occasionally. He said the state must figure out a way to give both Norfolk Southern and CSX access for all the benefits competition brings while creating better infrastructure to help ease traffic congestion created by trucks that use the port.

Summey contends that the rail provision violates a memorandum of understanding that prohibits trains from going through the northern end of the old Navy base. The mayor is trying to protect the communities where the city is investing in ongoing revitalization efforts.

The Statehouse provision calls for the Charleston Naval Complex Redevelopment Authority to transfer the rail line and right of way to S.C. Public Railways, a division of the state Commerce Department, as a way to guarantee dual access.

A similar measure was passed in the state budget, which Gov. Mark Sanford is reviewing. Summey asked Sanford to veto the rail access provision. Sanford is expected to announce his veto decisions today.


Proposed changes

The original intent of the bill was to make changes to the port's governing board. The changes, such as calling for a performance review of the port's chief executive, were seen as safeguards.

The House passed a long list of changes to the bill before it was sent back to the Senate. The amendments include adding more education and experience requirements for members of the port's governing board, allowing the governor to appoint members from each Congressional district and seating representatives from the Commerce and Transportation departments on the board.

The bill now calls for the port to sell land it owns on Daniel Island by the end of 2011, or the land would revert to another state holding. If it becomes law, the former landowners on nearby Thomas Island also would have the chance to buy back the land the state paid them to take away for potential port business years ago.

Money from the sale of that land could go to pay for infrastructure improvements in North Charleston, such as overpasses, Merrill said.

"The mayor says he wants less traffic so we're trying to figure out a way for rail to come in so there is less traffic," Merrill said.

The bill will be sitting on senators' desks when they return to Columbia today.

Senate Transportation Chairman Larry Grooms, R-Bonneau, said the Senate is trying to craft an amendment to the bill that satisfies legislators in the House and Senate. Given the little time left in the current session, amending the bill rather than sending it to conference negotiations would be the expedient route.

Grooms said his main objective is to stabilize the leadership at the port to give shipping clients confidence.

But Summey said there should be no discussion until the rail provision is removed.

Summey said the memorandum of understanding was ordered by the Legislature and also reviewed by the Budget of Control Board. Merrill said that document was signed by the ports authority, which he contends does not speak for the state. Summey called Merrill's assertion flawed.

The issue is bigger than North Charleston; it's about home-rule and a city's rights, Summey said.

I edited my high-school newspaper, so I do have experience, and I realize it would be a downward move, but I'm willing to sacrifice for the common good. Obama would be proud...

Its not to hard too fix there problem, so what have they got to loose? Me and them could get 'er done!

zoomru if you lived on braddock for years and were not harrassed by a train you are either deaf and dumb or a liar. The fact is for years the Cameron terrace, Oak Park communities protested the rail on North Rhett. This rail is about 100 yards from the mayors old residence. I too live in the area and have experienced the huge traffic jams on North Rhett due to a train stopping for 20 to 30 minutes. This does not mention the 30 times the train blows it horn while crossing Rhett. If you want to critisize Summey then do so on the fact his chief of police refuses to enforce the law, due to resources, when a sole train holds up hundreds in traffic because the railroad is slightly ahead or behind its schedule.

It seems like lots of folks in the Charleston area are hell-bent on running the Port out of town. I guess soon in order to live in the area and be gainfully employed one will have to be retired (having made money elsewhere) or work at a restaurant.

No one is turning down jobs. For the umpteenth time, the rail line can run through the SOUTH end of the naval base. This would create the desired results without the undesired effects on the revitalized areas of North Charleston.

I do not see why people don't get this. People have worked very hard and many dollars (private and public) have been spent to bring this area "back to life".

And, like has been mentioned, this north end rail line business will adversley affect the rail lines that already run through that area, doubbling or even tripling the rail traffic.

Will anyone ever be able to cross N. Rhett again????? or will it turn into a train parking lot??????

singleroni and adenosinetriphosphate - NOTHING has been said about not having a port or about running the port and it's jobs out of North Charleston. What has been said repeatedly is that the state needs to stick to it's original agreement, the one that spurred all of the growth that has occurred from the Noisette project, and not run rail through the North end of the base. North Charleston is the economic hub of the low country and has no problem staying as such, but if we are going to do that we should at least have some small bit of self determination on how that is going to occur. When the state can break agreements and other regions can request state money for rail lines to be placed in the city of North Charleston something is wrong with that.

zoomru - I am sure that you have a valid point to offer every so often but it is too much of a pain to try and find it in the crazily typed and cryptic writing style that you are so fond of. If you would like your message to be read I would honestly suggest that you try to type normally and stop with the suggestions and innuendo. Just my opinion.

Even though we have had our differences, I support Summey on this one! We moved to Park Circle because of the plans and potential that was outlined for this community. To have the Port Authority renege on their agreement is an outrage. This does affect people's lives! If they want to open the rail lines on the north-end and push this community backwards - then the Port Authority can buy my house and reimburse me for the moving expenses and home improvements! I love the neighborhood - but do temporarily tolerate the 'slums' because they won't last forever - unless you reactivate these trains. Talk about kicking us when we are down. I wish I could be there tonight! Summey has my full support! - Oak Park Resident

Please read posts from me and justjerry and anyone else from the Park Circle / Montague / Navy Base areas and see that no one is asking that no rail lines run through North Charleston.

The problem that we have is with THIS sepecific proposed legislation that negates a former deal that would forbid such rail lines to run in a very specific area of the city in order to maintain the revitalized integrity of that area.

Please show me where Summey's proposal eliminates or cuts jobs and potential jobs? Please show me where our stance inhibits port traffic in any way shape or form. Please show me something that makes you continue to repeat your so seemingly irrelevant thoughts.

People are so short-sighted! North Charleston has been more welcoming for industry, business and development than any other community in the region. We don't have an issue with trains in North Charleston, we don't want them running through a residential neighborhood that needs some revitalization! The Port Authority just needs to keep their word. This issue is bigger than just North Charleston. The Port Authority has been in bad shape for years and now they want to show some initiative! Do we want a rail line that will block 4 major traffic intersections (form the south end) or one that will block over 10 major intersections (from the north end).

If memory serves me correctly ......most of the rail going by when I sit at the tracks are for WEST Vaco and the Hess Terminal.

MAYBE The real stink is from WESTVACO ...NOT ....wanting more cargo coming out of the North END because they do NOT want more CARGO coming by their DIRECTION while trying to move WOOD CHIPS at the SAME time....!?!?! As far as the TRACK coming along North Charlesto High School...lets see...hmm ..... THAT HAS NOTHING TO DO WITH THE NORTH END OF THE BASE !?!?! Rhett coming out of the North END going to Dubai PORTS in Orangeburg (CLY-burg_) !?!?! It does not take a SHERLOCK to figure that out .....just look for yourself PARK CIRCLE and Cameron Terrace VOTERZ !?!?!

SOme cargo will go South but most will go ....WEST !!!

Citizens.......the FACTS surrounding all ramifications involved and experienced by all PLAYERs with a "Dog" in the fight should be exposed by this PAPER in complete detail with CHARTS and graphs with the VARIOUS developement versions EXPLAINED. The every-day comments about Summey's expensive office, CCSD, and NCPD are red herrings to this issue. Believe it or not, Summey has an obligation to his constituency to both encourage growth and temper competing interests. Expanding rail access to the new port in North Charleston is a good idea. Running all this expanded rail traffic through neighborhoods at the North end of the Navy Base, however expedient, is a big problem.

1. It will block Virginia Avenue, cutting off I-526 access to the East end of the town.

2. It will block North Rhett, backing up traffic leaving Park Circle but also (very significantly) traffic leaving I-526.

3. It will block Montague Avenue, cutting off the High School and Olde Village businesses. The real rub here is that people may no longer consider that stretch of businesses a viable alternative for a quick lunch or dinner, which by visual estimation is a major deal for them.

I want the State to thrive, I want the commerce, and I want the jobs to be here. However, the idea of basically erasing the oasis of class that has sprung up in Park Circle among the depressed and dilapidated surroundings breaks my heart. For those of you that haven't witnessed the drastic transformation, you're missing out. For those of you that think the trains won't be a big deal... if they weren't then the port would be a failure. A successful port will move hundreds or thousands of containers a day... at 10mph across our thoroughfares if we leave the plan as-is. Summey feels the same way as we do and is serious about it.

Jim Merrill is at the head of this movement? Really? I'm shocked that DI's representative, so proud of getting this horrible eyesore and traffic disaster off his idyllic island would be so vocal a proponent of doing the same thing to Park Circle. Shocked, I tell you!

When ALL citizens realize what is REALLY going on.......LOOK OUT !>?!>? Google EARTH is very revealing and PICTURES ..DON'T ....LIE !!!!!!!!

I honestly wanted to read what you wrote, but your apparent random use of the CAPS LOCK key and very, very odd paragraph structure make it so difficult to read that I, and I suspect many others, just skip over your posts to find someone else's post... that is easily readable.

There is an existing railhead on the old base. It runs out through the north end. This provides an immediate link for commerce vital to this area.
You "folks" can argue all you like over asctetics, but restricting economic growth is suicide for the north area.

rollo - where has anyone said anything about restricting economic growth? The plan to run rail through the North end instead of coming out of the South end is what would restrict any growth due to the extreme damage it would do to the progress that the Noisette project has made for the area. What folks are saying is that it would be better and make far more sense to run rail through the South end of the base, a plan that would minimize the impact on the residents and businesses that are near the base - most of which are at the North end.
