Police: Man speeding from domestic violence incident was reckless, didn't slow when he came up on SUV

Two people were killed in a fiery car crash early Monday in North Charleston when a man speeding away from a domestic violence investigation rammed a Cadillac into the rear of a sport utility vehicle stopped at a traffic light.

PROVIDED

The accident that left two people dead early Monday near Charleston Southern University blocked traffic on U.S. Highway 78.

A woman driving the SUV died at the scene, while the 28-year-old man who caused the wreck survived for a brief time. He was pronounced dead at Medical University Hospital later in the morning.

North Charleston police said the driver was reckless and ignored attempts to stop him before he caused the accident on U.S. Highway 78 near Interstate 26.

"I advised dispatch that I was traveling 55 mph and the suspect vehicle was pulling a good distance ahead of me as we passed Charleston Southern University," a responding officer wrote in an incident report.

"The suspect vehicle did not stop, did not apply breaks and collided into the back of an SUV in the middle lane," the officer also wrote.

The collision, just before 12:30 a.m., caused the SUV to catch fire. "The rear was sent spinning through the intersection and came to rest on the beginning of the Interstate 26 on-ramp," the officer wrote.

Authorities said the event moved so fast that it did not rise to the level of being a full-on pursuit. Elms Plantation Boulevard, where the incident escalated, is less than a mile from Medical Plaza Drive, where the impact occurred, a police official said.

The woman who died in the SUV was identified as Andrea Holmes, 50, of Ladson. A 24-year-old passenger was transported in critical condition.

The driver of the Cadillac was identified as Jason Grimsley, 28, of North Charleston. He reportedly was aggressive after the accident and had to be restrained and handcuffed to a stretcher before he could be transported.

The incident began about midnight when police responded to an apartment on Atlantic Palms Lane in connection with a female and an assault. Grimsley was described as the suspect.

Following an altercation, he reportedly took the Cadillac belonging to the woman while threatening to hurt himself with a knife, at one point yelling "suicide by cop, yahoo," an incident report states. A responding officer heard the car try to drive off, its wheels spinning on wet asphalt.

Another officer saw the suspect vehicle leaving Atlantic Palms toward Elms Plantation Boulevard, which connects to U.S. 78. The car was moving erratically, even running onto the sidewalk.

The Cadillac turned right onto U.S. 78. The accident occurred a short distance away.

North Charleston has an eight-page vehicle procedure document that covers a variety of situations and risk assessments in pursuits. "Officers must exercise sound discretion to engage and continue in a pursuit," part of it reads.

Attempts to reach Holmes' family were unsuccessful. The telephone listing for her last known address has been disconnected, a recording said.

A S.C. Highway Patrol official said it could be several days before investigation results into the crash are released.

I pray that all those effected by this tragedy are surrounded by the Joy and Peace of God through His Son Jesus Christ. It's very unfortunate that the young man chose to die this way. Unless he had a change of heart and saught God before he died then he is now spending eternity in Gahena. I pray that it's not so.

Didn't US Supreme Court take away the liability away from LEO's during vehicle pursuits? As long as the officer acted with the police department's policy and with the law, the PD can not be held accounted for the suspect actions.

I think is less the LEO's fault and more the Cadillac driver's fault personally. My intentions are not to write ill of the dead, but it was HE who caused this tragedy.

haroldreems - I'm with you on this one. I send my condolences to the families and friends also. I've been against high speed police pursuits for several years now. I believe the cost in human life that it usually involves, is just not worth it. It has even become televised entertainment, it is much like watching a Demolition Derby. If these pursuits are so effective, why do they continue to increase? The following article supports my belief.

High-speed police pursuits: dangers, dynamics, and risk reduction

FBI Law Enforcement Bulletin,The , July, 2002 by John Hill

High-peed police pursuits and the inherent risk of injury and death that can result constitute an important law enforcement and public safety issue. Police pursuits are dangerous. Available data indicate that the number of pursuits continues to increase, as well as the number of pursuit-related injuries and deaths. A traffic accident constitutes the most common terminating event in an urban pursuit, 1 and most people agree that these pursuits should be controlled. Yet, researchers note a widespread lack.

isharemyopinions - You are correct. Here is just some of what I found.

Federal Claims

In light of United States Supreme Court precedent, federal constitutional liability for vehicle pursuits is extremely limited

State Claims

Law enforcement managers must not only consider potential liability for pursuits in federal court, but must also consider various sources of liability under state law. Various states have motor vehicle tort claims statutes that govern liability for negligence under state law. This article will now consider state claims in several states.
( Below is just a portion of the article, I have provided the link to the complete article at the bottom ).

Clark v. South Carolina Department of Public Safety

The Supreme Court of South Carolina agreed with the analysis of the Court of Appeals. The Court went on to state

Police officers have a duty to apprehend those who violate the law and the decision to commence or continue pursuit of a fleeing suspect is, by necessity, made rapidly. However, a police officer's paramount duty is to protect the public. We acknowledge circumstances exist when it is reasonable for a police officer to adopt a course of conduct which causes a high risk of harm to the public. Nevertheless, such conduct is not justified if the public is subjected to unreasonable risks of injury as the police carry out their duties. We conclude that a law enforcement officer is not immune from liability under Section 15-78-60(5) for the decision on whether to begin or continue the immediate pursuit of a suspect.xxx

So how would you explain to another family or more when this clown killed others and the police failed to try and stop him? And you would let someone driving like a maniac and on the sidewalk just drive off? Second guessing is easy when you aren't involved. I don't blame the police on this, especially given the preceding events. Hell, he had to be restrained after the accident. This cat was out of his mind, angry and was hell bent on causing as much destruction as possible. There may be times when it is appropriate to cease chasing certain individuals, but with the facts presented here he was a menace to society and needed to be stopped. Condolences to the Holmes family, what a horrible accident.

Wow!!!
Harold - it's not a chase just because the emergency signals are on. CDV in this state is a huge issue and police are getting hammered for not doing enough and you want them to let the guy go? Why so he can come back and kill the girl after the cops leave? Oh and I doubt that they knew he was suicidal when the call went out. Those types of statements come after the fact. Harold I usually agree with your posts but on this you are wrong. Heart goes out to the Holmes family.

I can not explain how to tell ones family that their child, mother, father, brother or sister will not come home because they were kill by a suspect who failed to stop for police. Now do i agree in the actions of the LEO's... Yes. I believe the pursuit was warranted due to the nature of the crime. Do I believe all vehicle pursuits are warranted.. Depending on the nature of the crime. No.. I believe if you are chasing a vehicle because it has a tag light out.. I don't think that chasing a vehicle is worth an innocent life. Now CDV is a bad crime. Most would not agree but it is. Now the suspect had it in his mind that he was wanting to die.. Regardless if LEO's were chasing him or not. he had it in his mind that he was going to do what he was going to do..Before police even began to chase him, he was observed driving recklessly.

As most people that read news stories know all the facts are not always there or not correct. This story is fairly accurate. This situation unfolded so quickly that there was no time for a "high speed" chase. The driver of the Cadillac was not in full arrest when he was removed from the car. He had multiple fractures, a sever head injury and was highly combative, possibly from the head injury. I know because I was one of the people that helped cut these cars apart and remove the injured.

"Jason Grimsley may be to blame for this tragedy but he was in no way the monsterous person the media has made him out to be!"

Talk about getting your facts together...I don't think you have yours either.

This is not a "blame-game" here...this idiot or shall I say "monster of an idiot" killed an innocent driver; critically injured a passenger; put the lives of the cops at risk; endangered the public welfare; and God knows what he did to the woman he assaulted that caused him to run in the first place!

If Jason had any decency, morals, civility and/or common sense--he should have simply faced the consequences of his action and let the police do their job. He should have man-up and not run like a wimp!

So lady, there is more to the story than what you know...because anyone who runs from the police is either stupid or has something to hide or both! Unfortunately, this tragedy ended with fatalities--which should not have happened in the first place.

My heart goes out to the woman driver and her family...and I wish the passenger a speedy recovery.

this was a terrible accident.
we only know the the police are saying, whom they are blaming it on and why it suppoedly happened. none of us were in either car. we can never speak personally with the two people who died and the injured woman may never know for sure what really happened to them and neither will we.
we can only try to learn from what happened.
we should all try to put ourselves in their families places and remember that we would not appreciate anyone speaking ill of our loved ones. try to remember that no one in this world is perfect or without faults. we all say and do things when we are upset or angry that we would not normally do otherwise. we none have walked in Jason grimsley's shoes, we cannot know if he really meant to hurt himself or if he was using this as a scare tactic to his girlfriend. was he even more upset when he saw blue lights in his rear view mirror, did he panic and hit the gas instead of the brakes, did he even see the car in front of him? from all accounts, he never told his girlfriend that he was going to take anyone else with him to his death.
i am one of those people who believe that God has put me on this earth to do a job and that when my job is over, He will take me home. we can never know what went thru their minds and what was in their hearts. all we can do is learn from this accident and pray for both families.

Here and now is not the time to disseminate information that was gathered as you did your job. We as medical professionals, parmedics, firefighters, and rescue personnel are forbidden to give out information to the public. It violates patient privacy laws, also known as HIPPA. Here is not the place to "help the family put pieces together". There is a full scale investigation by several different police agencies with experts on accident reconstruction that will give accurate information to the families when the time comes. So Rescue4- shut up.

I believe all human life is precious...its tragic for all. We must remember that mental illness, ie...depression...suicidal urges, thoughts and actions...they are serious and sad. These are not excuses...but reasons. Yes, the actions of the driver of the caddy caused the accident which resulted in the deaths. I firmly believe that the intention of the driver was not to take anyone with him...and i agree, no one knows if he saw the other vehicle...hit gas instead of break...no one will ever know. Everyone deals with grief and shock in different ways...the mourning process is different for everyone...very personal. It is heart breaking to hear of the innocent lives taken and damaged due to this event. BOTH families have had their lives turned upside down. The WOULD HAVE's...COULD HAVE's AND SHOULD HAVE's can go on for infinity. Hate..resentment...these are all negative emotions that will not help anyone if they are out of control but, we as humans, have our process to deal with loss. My wish is for each and every one touched by this tragedy to be allowed to greive in peace...judgement is God's job...may God's face shine upon all and give them peace. My thoughts and prayers go out to both families...the families are also victims in this tragedy.

I am sorry for the loss to the Holmes family; as for Mr. Grimsley, he had SERIOUS issues as his girlfriend/fiance' had to call the police because of a criminal domestic violence issue; ask any police officer who attempts to charge and/ or prosecute these offenders and 99.9% will tell you that the victim(s) will not cooperate because " they love them..." as far as I can see, this man will no longer be able to cause harm to anyone else ever again...and believe me, he will have to answer to the almighty for what he has done; and lastly, if the LEO had NOT responded they would be getting ripped for it. Is it the family's duty to always say how good the suspect is? or how he was changing his life around? or how he would not have hurt a fly? I am sick of hearing it. Everytime a drug dealer gets murdered or a crazy person rapes and kills a college student or a drunk driver kills and innocent person, the suspect's family goes on and on about he was a good gentle person. And honestly, I would do the same in that situation. But realize it doesn't help the victim's family. Why couldn't he have been gentle that night, why couldn't he just stop and go to jail for one night, why couldn't he just...be gentle and kind? We will never know! I am begging everyone to learn from this and think about your actions every second. Think about your family, how would this affect my family, how would this affect my life. May God be with Mrs.Holmes, Jason, the families affected. God Bless.
