Man faces death penalty in killing

CHESNEE — A South Carolina prosecutor wasted no time telling the suspect in the killing of an 8-year-old that he was seeking the death penalty.
Solicitor Trey Gowdy said the notice was served Thursday to 50-year-old Ricky Lee Blackwell as he recovers in the hospital from a self-inflicted gunshot wound to the stomach.
Authorities say Blackwell put 8-year-old Heather Brooke Center in a headlock Wednesday, then shot her in the head and fired three more shots into her as she fell.
The girl was the daughter of Blackwell's estranged wife's boyfriend.
Blackwell is charged with murder and kidnapping. Authorities didn't release his condition.
Gowdy called the girl's killing an execution and said it was so shocking the perpetrator deserved to die.

Now here we go AGAIN;Blackwell will be found guilty and sentenced to death and housed at least ten years at tax payers expense estimated to be $14,000 per inmate per year.KILL HIM QUICK ! Why should he be allowed to live 10 more years ? I cannot imagine what the parents of that little girl must be going through.

To kill that baby in such a heinous way is beyond monstrous. This ANIMAL committed a crime that more than warrants the death penalty. They should allow the citizens to take turns torturing this POS....I have a few ideas if anyone wants to join the party. A little vigilante justice. I wonder if his doctors and nurses know what he did. Hmmmmmm, does anyone have a nurse's uniform that I can borrow?

Ohhh, it's a race thing. Well that doesn't mean that the DP was unfairly used, it just means it wasn't used enough. So do you feel those minorities shouldn't have gotten the DP, or do you feel that more majorities should have?

People saying he should be executed immediately are, to put it charitably, morons. The Constitution guarantees everyone due process of law. There is no exception for those accused of capital offenses. Your lynch mob mentality is anachronistic and has no place in the 21st century.

NakedYoga, I am not the Constitution, so I choose to prosecute him in a public forum without due process. He didn't guarantee that 8 year old child "due process" before pulling the trigger 4 times. KMA and CTC!

Since an execution is final I feel if even 1 innocent person is killed at the hands of the state then it should be banned. I can't recall how many people have been executed then proved innocent but it's quite a few. Life in prison without seems like an adequate punishment, but like the _lovely_one this guy really calls for extreme disposition. Not trying to start an argument, simply mho.

No, I probably wouldn't. And that's why it's good that we don't have the family and friends running the courtroom. The fact that it didn't happen to me doesn't change the fact that the United States, unlike the People's Republic of China, North Korea, etc. does not engage in summary executions without trial. No, actually, it's not, and I never "defended" what this sick person did. If you had even an inkling of understanding of the genius of the Constitution, you'd understand. There is a difference between condoning what this person did (which I do not, in any way) and being interested in the integrity of due process and constitutionally-guaranteed criminal protections.

Yes, I realize there are "monsters" among us, and I realize they don't care about other peoples' rights. However, we live in the United States, not China or North Korea.

Trey simply informed the defendant as soon as possible what his intent was, and rightfully so-obviously they have a case together. He has been charged and notified as required by law. In this forum-which is not a court of law-people are free to express their opinions-freedom of speech mean anything to you? Along with due process, people have the freedom to express their outrage, whether you agree or not. Now if someone were to act on their outrage, that would be another story. But if I were to say good riddance when someone gave him what he deserved, that is my right as well and makes me no lesser of a man or person. There are protections for all sorts of rights for people, not just murderers-guess everyone needs to make their stand somewhere. Ricky Lee Blackwell does deserve his day in court, but we don't deserve to support him for 10+ years.

My opinion is that this man deserves the death penalty and I also made a tongue in cheek comment about vigilante justice being carried out against him. I never once tried to take away this man's right to a "fair" trial. I merely left my opinion on a story.

What gets me is that this sick guy will plead not guilty, his trail won't be for another year or so, have a 4-5 week trail, be found guilty, and sit on death row for 20 years!
Have you thought about all the anguish the 8 year old's family will have to go through during the next 20+ years? Of course not!
To me, people like Blackwell are cowards! Man-Up! You were "man enough" to committ the crime so be man enough to plead guilty and spare us taxpayers and the family all this BS!!

I agree the monster should have his day in court unless by some stroke of luck, he dies. I'm all for the justice system. Let him go to court, be judged by a panel of his peers, let them deliberate - shouldn't take longer than 5 minutes. Come back with the verdict of guilty - sentencing phase, right then and there...death sentence...one thing left to do...give him his last meal...I'm sure someone has a stick of gum or a tic tac he could eat. Escort this waste of flesh to the gas chamber, the electric chair, or stick a needle in his arm and let the juices flow. It won't bring back that little angel he shot to death, but hopefully knowing that the world has one less monster in it will bring the family a little bit of peace.
In the real world, once convicted and sentenced to death, he'll have his right to appeal. How many years will he sit on death row? Our tax dollars paying for his up keep and this includes the family of his victim. Where's the justice in that?

Send this guy to siberia...every day he wakes up at 5am gets a tiny bowl of oatmeal....goes out all day in sub zero degree temperature...takes large rocks and builds a wall all day...then for lunch a piece of bread...back out to construct the wall. At night sleeps on a cold floor. Next day up at 5am...oatmeal...de constructs wall built the previous day...repeat. Anyone who tries to run...shot.

Oh really? Thanks for informing me on what the law is. Believe me, I know. My point is that Gowdy served Blackwell with notice of intent to seek the death penalty without going through any sort of discovery or evidence-gathering procedures. While I don't fault him for seeking the death penalty, I feel that it is unprofessional to do so at this juncture.

Get over yourself. Please point to where I said that people are not free to express their opinions. If you want to advocate free speech, then you need to respect the fact that I vehemently disagree with you. Just because I disagree with you doesn't mean I am wrong. It helps that I *gasp* have a law degree (and no, I am not a criminal defense lawyer, nor am I a plaintiffs' personal injury lawyer) and understand the intricacies of legal procedure beyond what you might see on TV or various websites.

He is lucky we are in the good ole USA and will get the just fair trail he does NOT deserve because we are a just civil country and not in China or Korea..but to bad its on our tax dollar.He will see the light of day for many days but when his day finally comes I wouldnt want to be in his shoes. Bad things happen to bad peole, if not in this world then in the after life. The process should be swifter to keep our wonderful god fearing citizens from an unfortunate waste of time and money but untill the USA can come up with a better process we'll just have to post our disgust and vent so that we dont mob and strangle the SOB our selves.

Reading comprehension is clearly not your strong point. I never condemned the punishment itself. I merely said that Gowdy serving notice of intent to seek the death penalty a mere one day after the crime took place is unwise and unprofessional. In South Carolina, you can't seek the death penalty in any murder; the jury must find that at least one of several statutory aggravating factors existed.
I also never said anything about the police, so we can throw that comment in the trash.
You still don't comprehend my due process comments. I am not suggesting that the police or the solicitor's office has violate this guy's due process rights. My comment referred to the lynch mob mentality on this forum, where people seem to suggest that this guy should be summarily executed without a trial.
Despite your best efforts to portray me as defending this person, I'm not. If he really committed this crime (and it sure looks like he did), then he deserves whatever is coming to him. The fact that we, as a country, guarantee a fair trial to even the most heinous and despicable of criminal defendants is a testament to why the U.S. is the greatest country in the world. You can still despise the person while advocating for the integrity of the system.
