Police charge brothers in deadly shooting

A man once dubbed one of Charleston's worst criminals is one of two suspects charged with the fatal shooting of a 15-year-old boy beneath an Interstate 26 overpass last week.

Rafael Sinclair Horlbeck, 22, had just escaped a murder charged in another deadly shooting after prosecutors opted not move forward with the case in March.

He was free on $50,000 bail in connection with the sexual assault of a child when he and his brother, Leon Willis Horlbeck, 32, allegedly shot 15-year-old Jermel Tyler Brown on June 30, Charleston police said. Brown, a student at Daniel Jenkins Academy in North Charleston, was found shot multiple times beneath I-26 near Huger Street.

Charleston Police Chief Greg Mullen would not discuss a possible motive for the shooting, but he said the case is yet another tragic example of why state lawmakers need to reform South Carolina's broken criminal justice system to get tougher on career criminals.

Mayor Joe Riley described Rafael Horlbeck as a "drug-dealing hoodlum" with an "astonishing" criminal record for one so young.

In 2006, when Horlbeck was just 20, police had already added him to a watch list of hardened offenders worthy of additional scrutiny by officers. The Post and Courier also featured him last year in "Law and Disorder," a series detailing how South Carolina's troubled probation and parole system allows habitual offenders to continue preying on the public.

Horlbeck was arrested for possessing a gun in July 2006 while on probation for a cocaine charge. He stayed free on probation after his firearms arrest. Three months later, he was charged with gunning down a man on a Charleston street.

In addition to the new murder count he now faces, Horlbeck is also charged with shooting a man in the neck Monday night in North Charleston, police said.

I wish you people would stop judgihg parents for childrens actions. Parents can rear there children into being productive citizens as children are influenced by the community, there pears, and other media negative knowledge.Children make their own decisions. Yes, I can speak and say this, and before you even attempt to think whether or not my children or non productive wrong answer . I am an African American and live in a single parent household raised a daughter that is own her second year of her colligate level and a son that is in the sail program at his school. So stop, think and listen before your so quick to respond. However those sick individuals who gunned down that fifteen year old boy should be sent away for a life time.

Good response, zetta0821. Parenting can be a challenge, especially since every child grows in his/her unique way and may demand different strategies from mothers and/or fathers to raise (as you put it) "productive citizens". I can see where bumpersticker was headed: we're all aware there are children who know when to ACT like "productive citizens" when in the presence of parents & family, but as a group, we parents must instill the values in our children that drive them to BE productive citizens (preferably, the type without quotes) no matter who's watching. Hopefully authorities have the right people in custody that are either responsible, or can identify guilty individual(s).

Sometimes, we think that when a African American gets kill at a young age, it's always drug related. We are so quick to judge what happens in this world today and that's why our society is turned upside down. When a moms raised a child as a single mother,it doesn't mean that she raised him/her to go out and do or commit any type of crime, we all want to raise our kids the right way, it's up to them to make sure that they carry that with them out in this world. Stop making assumption and gather the truth before we speak about another person child b/c the next time it could be yours and then see how you would feel about the neagative things being posted.

What happened to the times when kids could run around and play all day outside without supervision, and come home safe when the streetlights turned on for dinner?

aside from the tragic murder itself, the fact that R Horlbeck has been allowed to terrorize the community on a continuous basis is beyond reproach!

his picture needs to be placed with the Gaffney Serial Killer's as an example of what happens when the justice system no longer sees the forest for the trees. too many resources devoted to petty crimes while the real monsters run the streets.

sounds like Horlbeck's kill-rate is about the same as the Gaffey Serial Killer's. sounds like he got the same breaks.

our judicial system and the people in it are a joke, all they do is take your fine money and send you on your way... sounds like it's turned into nothing but a revenue generator instead of being a system to protect the people

our judicial system needs a complete overhaul, including the people in it!!

from what I hear this was a case of mistaken identity, they were actually gunning for the twin brother and got them mixed up

you better be ready to protect yourself people because our system has long quit doing it's job, too bad we can't yank the tax money back from them for not doing their job

Instead of you all arguing with each other, you need to take that energy and use it on the Solicitor and these sorry judges and prosecutors we have!! Oh, and the sorry state lawmakers under the dome in Columbia too!

I have met with the Solicitor and voiced my concern over the revolving door that people like Rafael and his brother have in our judicial system but I'm only one person. This makes absolutely no sense and the death of this 15 year old could have possibly been avoided if this thug was in prison. He just basically thumbed his nose at the SC judicial system--look at all the crimes/murders he committed while he was out on bail.

And he just shot someone in the neck on Mon!!! Wow!!

I am sick and tired of reading these articles like this: when will the time given to these BUMS mean that they stay there(jail) for exactly whatever the Judge sentenced them to...

yird, I saw on the news last night, that it comes down to plea bargaining so lawyers, prosecuters and judges spend as little time in court as possible. I think it was an interview with Charlie Condon, the interview was about the Gaffney serial killer, and his 30 plus arrests.

The judicial system is failing the people of this state, and the LEOs that have to deal with these scum everyday, while putting their lives on the line.

I wonder what would happen if a judge were held accountable for letting Rafael Horlbeck a "drug-dealing hoodlum" out on such a low bond?

A 15 year old kid is dead, and those that are supposed to uphold the law,(not LEOs) allowed these animals out to kill him.

somehow we need to find a way to hold these court officials responsible for what's repeating itself over and over on the streets

that's why I often say we need elected judges, so we can throw them out when they do stupid stuff like letting people like the Horlbeck's out over and over

they should charge the judges and prosecutors for letting this slime walk

much of the local murders are from young men that have been let out of jail for very serious crimes over and over again only to repeat them

I say if they commit another serious crime while out on bond then the judge and prosecutor that held that case should also be charged... they'll think twice about letting this slime out because they don't "feel" like taking to time to prosecute them

But you can best believe that if something happened to one of these judges or solicitor's relatives--God forbid--you would see a totally different sentencing. The P&C even profiled this guy in one of their stories!! It is the same guys that terrorize the public over and over and over!! Mike Vick got more time than this guy!! What is wrong with our society?

This is my first comment of any kind on this site. First off, I have read the comments on the post and courier website for about two years. And for all the people (not mentioning any names you know who you are) who constantly defend the thugs and criminals on this site, you obviously dont live in the real world and you all need to open your eyes. Let me give you a little "inside info" on this whole scenario that happened with these Horlbreck brothers. Rafael and his brother are career drug dealers. Rafael was obviously charged with a previous homicide earlier and the case was not prosecuted in March. The reason was because the key witness backed out and would not testify. This leads us to the homicide under the bridge. The "victim" was with Rafael when he shot the first guy. Rafael was scared that the 15 year old was going to rat on him so he killed him. Well when ke killed the 15 year old, his brother and the sumner ave victim was with him. Rafael once again gets scared and attempts to kill smalls on sumner ave. Word on the street is that he was to kill his brother next. I tell everyone this for one reason. To enlighten all the criminals have feelings too people and tell you to wake up. As much as this kind of thing is the fault of the criminals, our judicial system should carry this burden as well. Let me tell you, from someone that works around it everyday, it is absolutely sickening. If society would see what I do you would be horrified. The reason this happens because the solicitors and prosecutors and public defenders all live away from all these problems and it doesnt effect them. When was the last time you heard about a homicide or drug dealing or prostitution on Seabrook Island. Their defense will be well we dont have enough money to house the criminals. You know what, raise my taxes!!! Im sick of having to live with criminals, thugs and crooked attorneys. im sorry so long, just finally read enough on here. In my position Im not able to make a fuss, hopefully someone else will.
