Sullivan's Island smoking ban upheld

The state Supreme Court this morning upheld the Sullivan’s Island ban on smoking in the workplace, essentially mirroring a decision that came out of Greenville earlier this year.

The ruling is a victory for anti-smoking forces, who have passed ordinances in several South Carolina towns seeking to restrict indoor smoking, including in bars and restaurants.

The court did find the town’s original criminal penalty fine of $500 and/or 30 days in jail to be invalid because it criminalizes conduct that is not illegal under state law.

Sullivan’s Island has already dropped the criminal fine since the court challenge arose.
