Questions arise about conflict of interest

ST. GEORGE - Dorchester County Sheriff Ray Nash makes no apologies for giving his administrator's brother-in-law $65,000 over the plast two years to maintain the department's computer system.
He also has no regrets for paying his former campaign manager $1,500 a month as jail chaplain.

Nash says he is sorry he didn't keep a closer eye on his his former jail chief, who is accused of diverting tens of thousands of dollars from the jail to a personal account.
'None of this has been done in secret,' Nash said Thursday. 'Now that we've found a rat in the system, some people are couching this whole thing in subversive terms. What we've been doing is trying to make the best use of public funds. Sometimes that means hiring people you know and trust.'
At County Council's request, a forensic auditor is investigating the Sheriff's Office spending. The most significant finding so far was that somebody apparently siphoned off jail money. Nash said Captain Arnold Pastor, his former jail chief, diverted checks from a jail fund into a personal account. That account shows expenditures to a motel; $2,241 to Carnival Cruise Lines; a $599.45 cash card withdrawal on the Royal Caribbean International cruise ship Sovereign of the Seas; and more than 50 ATM withdrawals. Pastor has not been charged. Nash said the State Law Enforcement Division is waiting for the audit to be finished to bring the case to a statewide grand jury.
The auditor also is checking other bookkeeping irregularities, including payments to S&R Promotions, which installed a computer system for the Sheriff's Office. The company is owned by Ralph Reahard
of Tampa, Fla. He's married to the sister of Franklin Smith, Nash's administrator.
There's no indication of any wrongdoing, but the accounting of how the money was spent leaves much to be desired, saidaccording to auditor Ron Wise of Rachlin, Cohen & Holtz
of Fort Lauderdale, Fla. Wise will spend the next several weeks looking more closely at the records.
Another forensic auditor watching the investigation questioned why Nash would allow a relative to get the contract in the first place.
'That's a classic conflict-of-interest situation, because he's a related party,' said Jock Stender of Mount Pleasant, a fraud examiner and president of the Coastal Carolina Chapter of Internal Auditors.
Nash defended Smith's decision to bring in his brother-in-law. He said the department's computer system crashed, and none of the county's information specialists could fix it. Smith mentioned that his brother-in-law was a retired computer expert, and Nash said to go for it.
'His (Smith's) sister just happens to be married to a very competent computer consultant who has done a good job getting our system out of the mess it was in,' Nash said. 'On one extreme is to hand out political favors. The other is not to hire any relatives, and that would be wrong.'
The biggest problem is not who installed the system but the fact that it's not compatible with the rest of the county's software, Council Chairman Larry Hargett said.
'I would like to see all funds under the oversight of the auditor and finance director,' Hargett said.
Smith said there are no plans to switch computer systems but that they're working on a way to make the Sheriff's Office system more compatible with the rest of the county.
Stender also questioned why Nash made his former campaign manager his jail chaplain, since that also appears to be a conflict of interest. The Rev. Don Shackelford, a Baptist pastor, managed Nash's election campaign in 1996. He's getting $1,500 a month as jail chaplain, according to the latest records.
Shackelford said he was interested in ministering to inmates during the campaign, and Nash let him start volunteering at the jail, Nash said. As Shackelford's time and commitment at the jail increased, Nash said he thought it was right to start paying him. The money for chaplains comes from inmates' collect phone calls.
'It wasn't like I was going to bring my buddy in as campaign manger and start paying him,' Nash said. 'He was a known entity, and it made sense. I think a worker is worthy of his wages.'

Get real folks, this is the South and it's been done this way for decades. This isn't something new, here. We've all been aware of the politics of public service entities like the DCSD and we've not said a damn thing until now. Now we want to jump up on the wagon and start our own campaign to discredit a mans' reputation. Let's wait and see what the final outcome is before we start jumping to conclusions. If the audit shows that the Sheriff had any part in doing something illegal or morally wrong; we can deal with it accordingly. Remember, if you were charged with some wrong doing, you'd want the same consideration; innocent until proven guilty!

The question of whether the audit will show that anything legally or morally wrong has already been answered. See the article: "There's no indication of any wrongdoing... according to auditor Ron Wise of Rachlin, Cohen & Holtz."
Apparently in the minds of commenters, "no indication of any wrongdoing" can also mean certain indication of being "just another South Carolina political worm." In election season, it's to be expected that false charges will appear, and the true political worms will go on to make unsubstantiated character defamations (see Harpo and mac0cm4).

A good leader knows that not only should he do things correctly but also APPEAR to do things correctly. On the surface, this looks like a poor or naive decision. A simple bid process for this work would allay most concerns about nepotism and impropriety.

I am sorry, but to say that there where not IT Specialist in the area that could fix his network is a dam slap in the face to all of those IT's that keep Charleston Police, Mt. Pleasant Police and North Charleston Police department network up. Not to mention all of the colleges, the hospitals and other business that are much bigger then his department. This really piss me off, cause I am an IT and I know I could have gotten his dang network back online.

MR. NASH, THE CONVENTIONAL WISDOM IS TO NOT HIRE FAMILY MEMBERS ESPECIALLY IF THERE ARE ALTERNATIVES. YOU ARE AN ELECTED OFFICIAL AND SHOULD STAY AS FAR AS AWAY AS POSSIBLE FROM ANYTHING SMACKING OF NEPOTISM, CORRUPTION, ETC.
I had a wait and see attitude towards this debacle from the beginning. i'm a firm proponent of 'innocent until proven guilty' however Mr. Nash is making this very difficult for me to assume that he has no culpability in this mess.
AT WORST he knew of the irregularities and AT BEST he suffers from narcissism and naivete and frankly doesn't know when to shut up and stop putting his foot in his mouth. I pray it's the latter and not the former.

Remember, he didn't turn to his brother in law, the mechanic, who happened to like computers, nor did he appoint his buddy who happened to be "a nice guy" to be chaplain. These men were in the field of expertise he was looking for. I'm not necessarily saying this to defend Nash but there are a lot of paranoid people out there who don't trust anybody. It's commonplace today to look to family and friends first, even over other people who may or may not be more qualified.

In response I would only say that a bid process is more naive. If the sheriff knows an excellent IT specialist that can be trusted with the public money, why would a bid process necessarily be more wise. Perhaps no one would be accused of nepotism, but if there were problems with their computer system, it could be pointed out that the bid process is not the best in terms of producing a quality product. As it is, there have been no problems with the IT service, and we have his brother-in-law's company to thank for it. The truth is, a good leader should not make decisions for the sake of pleasing those who are campaigning against him, but instead should make the best decisions for the people he serves. There is no indication that he has done anything other than the latter.

Hey NASH...huge difference between the way you conduct private business and government business. You can't just go around hiring whomever you'd like without being prepared to defend your choices to the people you serve a little better than saying he "just happens to be married to a very competent computer consultant". What about the very competent computer consultants that just happen to not be related to folks on your staff? Show me, don't just tell me, that you considered them for the same task.
The excuses Nash is feeding us are INSULTING to the intelligence of Dorchester County.

Rich: i highly doubt he personally knew this IT specialist (was not his brother-in-law but one of an employee). he only took the word of an employee (not necessarily a bad thing). he went out of state for something that could have been handled by someone closer in proximity and perhaps for less money. and to infer that there WASN"T ANYONE here locally or within the state to handle that issue is NAIVE.
a bid process could and should have been circumvented if it was an emergency. however he could have easily contacted Sheriff Dewitt or Sheriff Cannon's IT Directors for some direction and would have had someone quickly address the issue.
the appearance of impropriety is important and occasionally a 'red flag' of misconduct. to not look at this particular incident as being indicative of a much larger problem is NAIVE.

i'm not trying to besmirch the reputation or credentials of this company, the onus was and still is on Nash to make sure things are done appropriately.
i'm sure this company is quite capable, but should not have been given the opportunity to work on this project without first exhausting every attempt to find a local vendor.

Just having an incompatible county system leaves the entire county vulnerable, or so it would seem. Why would anyone allow an incompatible system to be installed in such an important area?...unless...

Here's an interesting observation about Nash. If you would go back and string together quotes from him or his office, some of them clearly were made "off the cuff" with no thought of public perception. Here's the question; Is that good or bad? Clearly, Nash is not a politician (I actually mean that as a compliment). He's human, he makes mistakes like any of us, and I agree, he's terrible at covering them up. I think that's good. If anybody is in any office for any real length of time and you DON'T hear about any mistakes, that means they got away with it and the situation will obviously never get straightened out. With Nash, at least the truth ends up coming out one way or another. No Sheriff is perfect, but I think the public benefits in the long run from having a Sheriff who is not some slick politician.

ChrisPia - I understand, but what I meant was that because Nash is not good at playing the slick politician role, we are able to debate this in the public square and put pressure on him. All those in public office should have their "feet held to the fire". Political involvement for the people does NOT end the day after an election. People may be upset about Nash's comments on this, but at least he's not covering it up. With too many truly corrupt politicians, this story would not even have seen the light of day. Payoffs would've kept it hidden from public knowledge. Disagree with how he spends public money, but be glad that you know enough to present a case against his spending.

Sheriff Nash appears to be a controlling figure who does not like to follow anyone's rules but his own. Anyone knows that it's just plain smart to disburse governmental monies in accordance with State and/or Federal guidelines. I work for a school district and we make a profit by selling ice cream to students. That profit goes into the "Principal's Account" to be spent at the Principal's discretion, thus it is not part of the General School District Budget. However, that does not mean the Principal may make up his own rules for spending these fundraised funds; the disbursements of this money still has to be handled in accordance with State guidelines. When someone in charge thinks that they can spend funds in any way that they choose to benefit the staff and agency, there is a huge chance that there will be inappropriate spending. Guidelines and/or restrictions are in place for a darn good reason. I have no sympathy for Sheriff Nash; he has opened himself up to public ridicule by making poor, poor choices for someone in charge of such a major endeavor.

Can he used that money to do Highly NEEDED policework in the Communities?

The word for this is patronage. There is certainly nothing wrong with Nash employing these people, but it walks a fine ethical line and sacrifices the confidence and character instilled in him by the constituency that voted him into office.

Just my opinion, but I don't see a problem with that statement. Dorchester County has a very low violent crime rate when compared with the rest of South Carolina. Would you rather have a higher crime rate but a smaller budget? A Sheriff is hired to keep the crime rate down. You HOPE that he also can do this without wasting taxpayer money, but keeping crime down is (for most people) far more important. Nash has done a good job keeping crime under control in Dorchester County. The people of Dorchester County would be best served if he stayed in office, but became a far better administrator. Just my opinion.

He is a failure in this also....My Point is he should be concentrating on cleaningup crime not Martial arts,Promisekeepers,ALERT,State Guard,Police Dynamics etc....He was Hired as a Sheriff to Combat Crime.Just because he is 20% better than the State average doesn't mean he is a success.We Need someone that has a plan to reduce crime with experienced people...His Statistics are getting worse not Better.Look at the Dorchester County Budget Figures..

Every other time there has been a article about Nash in the paper all of LC Knight's supporters post crucify Nash and reference "Knight for Sheriff". They even talk about how much better it would be in Dorchester County if he were Sheriff. But yet there is no mention on today's board. Could it be that this sort of nepotism would be even more wide scale when and if Knight were to become Sheriff? Anyone who has lived in Summerville for any extended period of time knows that the good ol boy system is alive and well. It does not matter what your qualifications are but rather who your parents are.

Hiring your relatives...give me a break...how stupid can you be. Those in authority that have so much power and influence can be so stupid. It is not a good idea to keep the same people in for too long, I guess. It goes to their head, if not their pocket.

Their own site is one page, no menu, no real background, no real information, no contact information at all. There is one link to what appears to be a completely different company. It says they have clients from coast to coast...I have clients from England to Australia...I wouldn't contract any of my work to him. If he can't do a better job than that for himself why would I hire him to embarrass me? If this schmuck got paid $65,000 to work for the sheriffs department someone got totally screwed.

The so-called computer "crash" referenced by Nash never occurred. This was the time that SLED mandated software for all police and sheriff departments to be compatible with SLED's for reporting purposes. At that time, the Sheriff's department (Nash) was using a commercial program called OmniForm to produce incident reports. While this worked, it was too cumbersome for SLED. He was under pressure to come into compliance. He hired Bo Reahard to 'build' him a program. While I have no documentation to verify this, I am informed that this cost the taxpayers of Dorchester County well over $50,000. Oh, by they way, this program operates off of an Access 97 front end....they don't even make Access 97 anymore.
It's funny. the complete, turn-key operation for a compatible system cost St. George Police Department only $15,000. They virtually have no maintenance on this system, and do not pay someone like Mr. Reahard exorbitant amounts of cash to keep it "fixed"
As to the comment that no one could fix the system....tase the Sheriff. I could fix it blindfolded.
I hope all of this is eventually revealed so everyone can finally understand that we, as citizens of Dorchester County, are not and have not been getting what we paid for.

Access? I wouldn't even run a police department on the latest Access, much less 97. Why wouldn't they be using a server based db rather than a file based system? MySql enterprise is only $500/year. For $65,000 I could have built the system and included MS Sql Server with quite a few years license. They could have had Oracle...$65,000 for an Access 97 system?
For those folks who say he isn't part of the gob system...apparently he is...his religous gob system. These people all seem to have religious ties to the sheriff and seem to be largely incompetent. Googling Bo Reahard comes up with numerous religious links and little hands on IT experience. His experience seems to be mostly management and sales.

Franklin Smith used to be involved in The Way. I was sitting three rows back from the pulpit when he asked the congregation, corporately and individually, to forgive and welcome him back into the fold. His son Yeadon worked the front desk at DCSO one summer in between missions. Nash sold his Givhans property and moved to Wescott Plantation about 18 months ago. His wife is a sweetheart. He likes a cold beer on a hot day. He used to own a daschund but gave it away because it bit one of the kids. Don Shackleford beat hell out of his ex-wife in their front yard 10 years ago. Nash, who was sheriff at the time, went to family court with him. That's all I know and I'm stickin' to it!

Nash cannot possibly supervise every moment of every employee and there are bad apples in every barrel, but to imply that Nash is bad simply because of the actions of another is lunacy. Really people can we dialogue at greater than a 9th grade education level here?
Its plain to see this article is politically biased designed to paint Nash in the worst way. The insinuations and wording border on yellow journalism and the reporter should be ashamed!
Major Johnson - as much as you may want you cannot separate a man from his faith. That is who he is at the core. And people who take voting for someone seriously want to vote for someone they believe will represent them the most. Ray is popular because he speaks plainly and I take comfort that he is guided by his faith. The fact that he is a religious man does not negate his exemplary performance as Sheriff and as far as I know Dorchester County's crime rate as low as it is reflect his high standards and strong ability to lead the county law enforcement personnel.

i am neither a disgruntled employee or relative of anyone involved. but you can't argue report after report. he never thought he would get caught because he thinks he is above the law. it was only a matter of time before things would catch up with him. as far as him charging a processing fee....i remember some people saying they deserve it because they are criminals, i recall some saying they were innocent until proven guilty so they should not be charged. nash never took that into consideration, that they still had to stand trial and were not found guilty yet. he just wanted their $. wonder how he feels about that now... how is he going to feel if he is investigated and arrested. Have anyone look into the relationship between Lt. Everett who is employed by DCDC, Rev. Shackelford and Sheriff Ray Nash. Lt. Everett Has been ordained as a Pastor under the leadership of Rev. Shakelford at Flower Town Baptist Church in Summerville. Rev. Shakelford operates a half way house program for inmates that are recruited from the jail by Lt. Everett. He often gives them a ride from the jail to the half way house using the county car and helps him self to the drug kits that are for the jail use to randomly test the boarders at the half way house. I wonder what else is he supplying to the half way house at the jail expense after all he is the ordering and purchasing Lt. for the jail. The half way house is ran like a cult the inmates must find a job upon getting their paycheck is given to Pastor Shakelford for room and board. The inmate at no self time and no control of their monies. Monies are allowanced out as Rev. Shackfelford deems necessary. They are to attend every church service if they are having programs Monday thru Sunday they must be there leaving no self time are allowing them to choose their place of worship . I wonder do they make them pay a tenth of their income to the church. The bottom line is officer inmate relationship here we have a Lt Everett/ Pastor that recruits inmates for Rev. Shakelford halfway house and church who just happen to manage Nash's election campaign in 1996. He's getting $1,500 a month as the jail chaplain and I wonder how much money from the inmates' recruited by Lt Everett/Pastor and how much money does Lt Everett/Pastor make from the church. After all Sheriff Ray Nash stated a worker is worthy of his wages.' The audit should include the halfway house being it is so closely tied to the jail. Can Lt Everett/ Pastor be fair and impartial when inmates that were once part of the half way house return to jail this is truly a conflict of interest.

I am sure that Sheriff Nash was a fine police chief in Summerville and has done some great things for Dorchester County but he admits no wrong doing in this matter he is the leader the Captain of his ship so-to-speak. Oddly, this whole thing does not pass the smell test. It genuinely does not smell right. Maybe he really thinks it is okay to have a relative(s) or close friend(s) handle these things. If that is the case future leadership of Dorchester will be based on this premise business as usual. Many other counties in the United States would probably call for a re-election, resignation or impeachment of his office. The citizens/taxpayers do deserve proper accounting hopefully the Sheriff will take command of his situation before he gets in too deep.
It seems extremely odd that this particular hired-help was all he/they could find to do the job. Perhaps that would seem like a valid statement in Hampton or Allendale Counties, but Dorchester County??
I believe that several of the postings are meritorious but to assume that the Sheriff is not responsible for what his staff is doing/or has done is flawed. Further that the readers and commenter's of the article for this Charleston (and surrounding area) newspaper are only the disgruntled employees of the Sheriff's Department or relatives of people running for office (in Dorchester County) seem grandiose.

I have no connection to Dorchester county or the sheriffs department whatsoever. As far as I know, I don't even know anyone who lives in Dorchester county. From what I've seen the county got about as screwed as it's possible to get screwed contracting this fellow traveler of Nash's for computer services. From what I've seen Sheriff Nash is far more concerned with padding his religious good old boys pockets than running the sheriff department. This is the sheriff who wanted to fire any officer who lived out of wedlock...he wanted to fire anyone with a pierced ear for pete's sake...Frankly, I wouldn't give a thimble of warm spit for what religion he is. I do know that if he was Wiccan and doing the same thing the Christians out there who are defending him and his morals right now would be ready to burn him and his buddies at the stake. Hell, if he was Wiccan or Hindu he could do the job well and still be burned at the stake by you religious zealots who really seem to only be concerned with Nash's faith, not his competence. Religious zealots are every bit as scarey as socialists, and every bit as damaging to the county, the state, and the country.

One of the former employees at the Detention Center had a record of passing bad checks. He was a member of the Congregation at the same church at Nash, and help was given him to expunge the check charges so that he could gain employment at DCDC Annex. Being 6 foot 7 inches tall, he seemed formidable enough, and maybe Nash thought he was doing a good thing in helping him. The same employee was fired for taking his wife to the emergency room and "adjusting" the dosage on a prescription for Lortab 5 mg. to penciling in a 7. to make them 50% stronger. I wonder if that is the only time that Nash hasn't been such a good judge of character?

look around, there's a serious shortage of good IT people around this area... that's why several agencies and private org's use out of the country Indians and the likes
if the people in his list of contacts couldn't fix it and some family member that was an expert computer guru could I'd go for it too
I don't care if he's family, I care that he can fix it and fix it soon
same goes for the Chaplain, he was already in place and the people he was helping had already built a trust/relationship with him... go for it
I live in Dorch Co, it's my tax dollars well spent IMHO
kudo's Sheriff for having the testosteronal fortitude to move forward and "git er done" regardless of what critics may say
and about the people that may work for you that end up being not of the best character, too bad so sad for them... there's a crook in every corner in any job where there's more than a few people
it isn't the bosses fault his people turned out on the wrong side, you go with what you have for information until proven otherwise
there's no crystal ball you can rub to let you know ahead of time who's the guy/gal that's always had an excellent reputation but will ultimately end up being a crook down the road due to a really bad decision on their part

The other guy is regressive, just ask the residents of Dorchester County who were around when the department was a family business not too many years ago.

Ray Nash has done an excellent job for the citizens living in Dorchester County IMHO, my neighborhood is virtually crime free and has pretty much been that way for the ten years I've been here... as well as the neighborhood I was in for 5 before this one, in DorchCo
of course you'll have a domestic here and there anywhere but knock on wood there's been no car thefts, no home invasions, women walk/run this area before and after dark with no fear and I can keep going on and on
I could care less if he hired qualified family members, and he didn't in this case, as long as they are qualified to do their jobs and do them professionally
and I could care less about your dribbling whiny complaints that make you look like a bratty pre-teen that someone stole his girlfriend and is trying to get back at him
Military training is a great thing as long as they realize they are a civilian agency and from the civies for the civies to include protecting us from the actual military in case of need... as one of the reasons police forces were originally intended to do
I train as often as I can as well, getting ready to go to a few day Israeli special ops training camp just because I believe in being prepared for anything in this ever changing world

as far as how long you've been here in DorchCo, my families been here longer than most by a several hundred yrs... they came in at Dorch state park on DorchRd back when that became a trading station for the Indians by boat/ship and we actually have family grave sites right there
