Motorist says Ervin pointed gun at her
MOUNT PLEASANT — A rookie solicitor was arrested Friday and accused of pointing a loaded gun during a road rage incident on the Arthur Ravenel Jr. Bridge.
Ninth Circuit Assistant Solicitor William Grayson Ervin, 29, of Charleston is charged with pointing and presenting a firearm, Solicitor Scarlett Wilson said.
A woman driving toward Mount Pleasant on the bridge about 2:50 p.m. reported that a man behind her was trying to get around but couldn't. When he finally passed, he pointed the barrel of his black handgun at her, Mount Pleasant police Lt. Sean Kenneally said.
The 44-year-old Mount Pleasant woman called police and reported the man, gave a description of the vehicle and a license plate number, Kenneally said. He said an officer spotted Ervin's GMC Yukon heading north on U.S. Highway 17 near the Brickyard Plantation community and stopped him.
Kenneally said police found a loaded Glock Model 27, .40-caliber handgun in the sport utility vehicle. There was no round in the chamber, he said.
Ervin gave a different version of events than the woman. He told police that there was a man in the passenger seat of the other car and that the man showed a gun, Kenneally said.
"So he showed his," the lieutenant said, adding that Ervin denied pointing the gun.
The woman told police she was alone.
Wilson said she had not spoken to Ervin but she will fire him when she does.
"He is no longer employed," Wilson said.
Solicitor and police alike said that whether another person showed his gun first was not an issue. It's illegal in South Carolina to show a firearm.
"The way to handle situations like that is not with violence or the threat of violence," Wilson said. "You do what the woman did. You call the police."
Ervin is expected to have a bond hearing this morning. Police weren't sure if he was the registered owner of the gun or if he had a concealed weapons permit. Wilson said Ervin formerly worked for law enforcement in the Myrtle Beach area.
Ervin graduated from the Charleston School of Law in the spring of 2007 and served as a law clerk for the Solicitor's Office for about three years while he attended school, Wilson said. She said she hired him as assistant solicitor late last summer, when he passed the bar exam.

There must be a communication meltdown here. I even looked at http://cedarposts.blogspot.com and I still don't get it despite my well-known brusque sense of humor.
The only jokes I see in reading posted comments about Scarlett Wilson are where supporters of Blair Jennings are grasping at straws to attack Wilson. If there are specifics against Wilson would you please let me in on it before the election?

P. drive like idiots everyday and should be kept in check, but ROGUEs that think they are big men with big guns should not be the ones to do it. Maybe if we all carried painball guns in our cars and shot the poor drivers' cars, everyone else would be able to tell who the idiots were and steer clear of them... just a thought.

I know Gray personally. He's generally a nice guy. While we don't have all the facts, it's most likely that he has made a terrible mistake.
Gray is a hard working person. He has dedicated himself to law enforcement and public service. If the article is accurate, he has shown very poor judgment. Hasn't everyone done this at one point or another? Everyone makes mistakes. Everyone.
As far as Solicitor Wilson . . . Shouldn't she wait for the outcome of a trial? I don't want my solicitor to jump to conclusions concerning the guilt of an accused person. I do expect my solicitor to prosecute those that violate the law throughly and dutifully, but within the confines of the system they have sworn to uphold. Does public reprimand of an employee while not having even spoken to him personally meet our collective sense of justice?
If the article is right, Gray is clearly wrong. It also looks like he's lost his job. It looks like he may face a sentence of some sort. He has already been publicly humiliated. Do you really want to try him on this comment/posting board as well? He should be punished if he is wrong but we have a system for that. Stone throwers on electronic posting forums are not part of that system, at least not the last time I checked.

Since you ask for more information on Scarlett Wilson, I feel a duty comply for you and others.
In a short time in office Mrs. Wilson's work history has been nothing short of amazing.
1. She's vastly improved the relationship between prosecutors and law enforcement, to the unanimous approval of almost every agency (CPD, Mt. P, CCSO)in our jurisdiction.
2. She's made serious efforts, with mixed results (from the bench), to revoke bonds on repeat offenders and get violent offenders off the street while awaiting trial.
3. She's vastly reformed the lines of communication between the prosecutors' office and the county clerk of court to insure public records are quick and accurate and put an end to long running internecine fued between the two public agencies.
4. She promptly addressed the murder back log she inherited in office to a stunning degree of success. I believe there were 7 or 8 murder trials in 2007 (with about 60 awaiting trial) - so far in 2008 there have already been 5 murder trials, all convictions.
In short, Lilly, in a very short term in office, she has made amazing strides to fix the issues so often complained about on this board.

So who on earth would oppose this? Aren't these good things? The answer is yes to all but all but one group. The private defense bar makes a living off the inefficiency, ineptitude, and good ole boy connections of our S.C. system. They're terrified at these changes. Accordingly, they have presented a perfect puppet candidate in Blair Jennings, a man (though a decent person I hear) who has very personal connections with several of our city's most prominent defense attorneys. This is not some crazy conspricay theory - it is documented fact.
A prosecutors job involves making tough decisions. By thier very nature - you are not going to agree with every decision the office makes, but the community should expect the decisions to be made promptly and fairly, and most importantly - independently and bravely (no matter the political pressure).
Ms. Wilson bore the brunt of criticism for a recent decision on Wando robbers, but she made the call that no one else wanted to make (and I would add, on a case she could have easily postponed until after the election if she was more concerned with political fallout and had no integrity).
What was Mr. Jennings response to this case - "I don't have all the facts to say whether I approve, or disapprove, or her decisions" - I'll leave the call up to you - is that a prosecutor or politician?
This inicident with the rookie prosecutor and the gun is appalling, but Ms. Wilson is acting promptly and fairly and is about as much to blame as that Ashley High principal is for that teachers DUI last week (not at all).
Do not be fooled by the transparent people on this board whose obvious agenda is to get their good old connected friend elected. For the next 6 months they be on here turning any article about crime or prosecution into a ball drop by Ms. Wilson. It is deeply saddening.
This summer we have a choice between a prosecutor and a slick politician for this important office. I certainly hope it turns out one way (try and guess which!), but my experience in S.C. tells me otherwise and that's kind of depressing.

In some cases that may be true...nothing good comes from someone with a temper carrying a gun, who suffers from road rage. It will be interesting to hear the outcome of this situation. I agree that we have not heard all the facts, but she said he had a gun, described it as black, which is what they found in his possession, so I believe that what most of us believe to be true will be established as fact. So, I say we all leash up our Labradors and run along the Battery after having another cup of coffee.

I also want to comment...and it has nothing to do with this article, but the article seems to be missing from every source. Yesterday, I was reading the Journal Scene online, and saw an article that referenced a trucking company employee finding packages on the ground where a truck was parked that was heading for Lieber Correctional. That article is now missing, but I swear it said that they found cell phones, marijuana, cocaine, and it was traced to the truck, which still had packages taped to the underside of the trailer. I wonder where that article has gone? Why would it simply disappear from the JournalScene and never make it to the Post and Courier? Curious, Indeed.

Thank you blackwoman, your opinion makes alot of sense. The only thing I see Ms. Wilson doing is her job. Of course she tries to further her career by trying these cases. Everything I do all day long is to further my career. The same with every other person posting here. If they commit the crime, they need to do the time. There are certain jobs that people hold that they have to mind their p's and q's everyday. Mr. Ervin has one of those jobs. The same could be said for a teacher, etc. He needed to conduct himself in a more responsible manner. He failed to do so, and he now has to pay the price.

The charge of Pointing/ Presenting a Firearm requires a victim such as the girl the gun was displayed at. Two significant things could happen here:
1) The victim "decides" not to pursue this and it all goes away.
2) The solicitors office allows the defendant to enter PTI (Pre-Trial Intervention) and it all goes away and is expunged from ALL records as though it never happened. (Solicitors will tell you that they have the right to send someone to PTI even if the arresting officer objects. Funny thing is they still send a form to the arresting officers asking if they object.)
A charge of unlawfully carrying a firearm does not require a victim. If the subject had the gun out of the glovebox while driving then that is also Unlawful Carrying of a Firearm and is not a double jeopardy charge.

Really? Using that logic, every president is a wacko (of course, some may not disagree!). Every attorney general is a wacko. Hell, every elected official is a wacko, since almost all of them replace at least some of the staff of their predecessor. Every CEO who has taken over a company and replaced underlings must be a wacko too. When I bought my house and didn't keep on the same maid service the previous owner used, I guess I became a wacko too.
I know next to nothing about Wilson or Jennings. (And I'll admit that.) But the fact that he's running against her doesn't exactly make the case for him being an outstanding employee choice to be under her.
He may have been outstanding at his job. Don't know. But I know Wilson did the right thing in the case of the Wando kids and she did the right thing letting this gun-waving buffoon go as quickly as possible. If there are some bad things about her, then give us voters more than "she's a wacko" and she's suffering a "failure of command." That doesn't mean anything. Give us facts.
And Motoryacht, I respect your opinions and have been enjoying your blog. But when you get on Wilson, your diatribes sound like nothing more than campaign material for Jennings. Show us why Wilson is bad. If there's something there, she won't get my vote. I mean it. But the fact that she fired Jennings and did her job with the Wando kids isn't enough.

MotoryachtSoCo this is not a credible answer. I actually know a nincompoop on the bench who cited the Peter Principle as their rational for why they thought they would be a good judge-and the wee toady got elected.

I have known Gray my entire life. It is outrageous to me that anyone leaving comments would judge him without knowing the circumstances. Obviously, if you are aware of anything other than the biased article you just read(as well as initial reports), you would know what type a person Gray Ervin really is. You would know that he is the kindest, most hardworking, moralistic person you have ever encountered. You would know that Gray would NEVER harm or put anyone in danger. You would know that he was raised with absolute perfection and with a family anyone would pray to be blessed with and call their own. It is offensive and appalling that anyone would judge and persecute someone based on a newspaper article. While I'm sure the situation is hindsight 20/20...anyone who has labeled Gray as a "thug" is sadly mistaken.
