Gardner execution set tonight
State high court denies request for stay

After 13 years on South Carolina's Death Row, convicted murderer Joseph Gardner is scheduled to be executed tonight by lethal injection in Columbia.
Gardner is set to die at 6 p.m. for his role in the rape, torture and killing of 25-year-old Melissa "Missi" McLauchlin in December 1992.
Gardner helped brutalize McLauchlin at a North Charleston home before he shot her and dumped her body along a Dorchester County road.
The state Supreme Court on Thursday denied Gardner's request for relief and a stay of his execution. He can appeal that decision to the U.S. Supreme Court, but had not done so by late Thursday, according to court officials.
Gardner also has not requested clemency from the governor's office, according to Joel Sawyer, the governor's press secretary.
Gardner would be the 281st person executed in South Carolina since 1912, and the 40th inmate put to death in the state since the death penalty was reinstated in 1976. He would be the third inmate executed in the state this year.
McLauchlin's parents, who live in Live Oak, Fla., don't plan to attend the execution. Her father, Clair McLauchlin, has said the event would simply reopen old wounds and do little to ease the grief he and family have endured since Dec. 30, 1992.
On that night, Melissa McLauchlin got into a car with Gardner and other men after they spotted her walking along Rivers Avenue in North Charleston. They took her to a mobile home on Stall Road, where she was raped by several men.
The men later forced McLauchlin to bathe, bound her with a blindfold and handcuffs and placed her on the floorboard of a car. Gardner shot her twice in the face after she freed herself from the handcuffs and tried to escape.

He then shot her three more times and left her to die along the side of a road in Summerville. Gardner, who was in the Navy at the time, fled from the area and remained a fugitive until his arrest in Philadelphia in October 1994.
The Detroit native was found guilty a year later and sentenced to die. Two other men charged in the case received life sentences for murder, and two others who prosecutors said raped McLauchlin each received less than 10 years in prison as part of plea deals.

Governments have a responsibility to punish criminals, and some crimes warrant the death penalty. The justice system is laced with uninformed and mistaken apologists for criminals that need to be killed, and I suspect that they deliberately slow down the process.

I clearly remember when this happened. The P&C is being very PC in the description of this crime, One example "The men later forced McLauchlin to bathe". It was the most horrifying, terrifying, brutal, disgusting, revolting, sick inhuman gang rape physical and mental torture and murder of another human being that I have heard about in my life.
moonpie, if it had been reversed there would still be no streets left here. Even Robert Ford stayed quiet for a while after this.

It's sad to know that a man is sitting in a cold cell knowing his death is coming in the next few hours- I cannot imagine the thoughts running through his head...BUT I cannot imagine the victims thoughts as she was tossed like trash on the side of the road-thinking of never seeing her family again, I am going to die....the fear and torment this woman was put through far outways my sympathy for him...he committed a horribble crime and now he is going to die, but the difference is that he chose to die when he did this- she had no choice...

If I had my way, as soon as he was found guilty beyond a shadow of a doubt in a fair trail he would have been sitting there knowing his death was coming within 30 days! It is total BS we had to pay for him in prison for that long.
The problem with the way we punish people for violent crimes is it takes TOO long. Society forgets what really happened, the story is diluted. They should of had every last one of those SOBs swinging from the gallows in front of the court house within 30 days max! The public should SEE it and know (and remember) that THIS is what happens when you choose to act like a complete wild animal.
I'm not sad a bit for Gardner, he gets far less than he deserves but I'm totally heartbroken for Ms McLauchlin and her family, they didn't deserve any of this and I'm sorry the state has dragged its feet for 13yrs before justice could be served.

Well the best that victims family can hope for other than some closure is that the injection fails somewhat and he has to lay there suffering for an extended amount of time. It shouldn't be easy for him, it should be painful, it should be long and drawn out. That it the problem with today's society, if you commit a crime of this nature and if sentenced to death you know it will be done as painless as possible because of "your rights". Why is this? bring back being drawn and quartered. Maybe these types of things wouldn't happen, nahh who am I kidding this will never change until the court systems change.

I really -usually- enjoy reading the comments from folks I might not know personally, but that I can relate to. This morning, though, the comments are so polarized. On the one side, the liberal who doesn't want to see the positive, deterrent value of capital punishment. On the other, some who would be overjoyed at the prospect of vigilante justice. Neither position is "right" from the perspective of victim, perpetrator, or society. The victim deserves "speedy" justice (as do the accused). The accused (according to the Constitution) deserves a speedy trial of his peers and a reasonable appeals process. Society deserves to know the "facts" that are involved in criminal behavior to be able to deal with present and future situations.
Having said ALL that, the problem here is that the appeals process has become, more or less, a roulette wheel that a criminal's lawyer is allowed to spin numerous times until he either gets what he wants or runs out of money. The appeals process (IMHO) should be limited to a specific period of time - then justice, as those peers determined, should be carried out.

This is NOT "vigilante justice", slow and drawn out justice for sure, but justice imposd by the people of the state of SC and the State itslef.
The appeals process has been corrupted by bleeding heart leftists and of course the ACLU. The states have a right to execute those found guilty beyond a reasonable doubt.
1 appeal to the State supreme court and thats it. The federal government (SCOTUS) has no constitutional right to interfere in the states right,(10th amend).
But of course, we all know that the federal government, soon or later finds away to inject itself into the states business.
Placing an undue burden on the state taxpayer to continue to re-convict a murderer several times and maintain his existance in a penal institution all the while.

Cold, I don't know if this would be "vigilante justice" but it seems that turning the proven guilty perpetrators over to family members (after a fair and just trial)to do with want they want, might discourage some in the future from committing similar crimes.
If punishment were to fit the crime it might be in violation of the eighth amendment but are not liberals always quick to point out that the constitution is a living document and subject to change determined by the times we live etc.?
Would they suddenly be in favor of the constitution remaining as it was intended by the framers? You betcha!

I agree with you that would discourage further crime but it would never fly for the reasons you stated. As I stated in my earlier posts I am a big fan of bringing back public hangings shortly after the verdict is in for violent criminals. When done properly, the neck breaks, so it is very quick and not "painful" so to speak. I do think it would have a HUGE psychological effect on others thinking of committing crimes but our society is too soft for this as well... so we continue to get what we are currently experiencing. Doing the same thing over and over in the justice system will continue to produce the same results, over and over.
For example, and their are many of them, not just this one, and no I'm not a racist, but the "Gangsta Rapper" mentality is a real problem. Kids think its cool and ok to act that way because the hear ______ degrading women, using the N word, selling drugs, robbing, murdering, rapping, etc 24/7!!! Why won't Society and The Media stand up against them and say "your wrong - your music is poisoning our youth, we don't support you, we won't buy your crappy records, your out of business." Where is Rev. Wright? The NAACP? The parents? WHY WON'T THIS HAPPEN? WILL SOMEONE ANSWER? PLEASE, I WANT TO KNOW!
I understand freedom of speech and expression but you can't yell FIRE in a crowded theater either.
As long as it is cool to be a criminal and there are no real threats to their own person involved we will continue to be a society that breeds violence. Their ethics are obviously completely gone so "because its wrong" doesn't deter. Prison is "cool" because ______ says it is on the radio so thats no big deal. Prison may be a thought in the back of their mind but it can't be SEEN. Convicted fellons SWINGING in front of the court house can. That burns a mental image into their mind and just maybe, they would think about that before committing these unspeakable crimes.

I was watching the OJ sentencing as I ate lunch at the Dog and Duck, but I couldn't hear the TV too well. It sounded like they said minimum 15 years, as much as 21 years depending on the parole board's decisions at the time. Was that the case??

This story sickened me in many ways, I was probably too young to remember when it first happened, but my parents say it was a huge deal in the media at the time. My thoughts are with this young woman's family, who have honestly said that this wouldn't relieve any of their grief.
I'm sorry, even though I definitely won't nearly be shedding any tears for this psycho (good riddance), I still don't buy the idea that the death penalty is a deterrent. Many of the people who we say deserve the most serious punishment are indeed psychos or sociopaths or both. (Your serial killer, torturers, rapists...general disgusting human beings). Somehow I don't see those people stopping before they commit a horrible crime and saying "wow, let me think a second, I might get caught and get executed." I remember having this discussion once with a group of friends who had varying views on the death penalty. I told everyone that punishing someone with death, isn't necessarily the worst punishment, because death isn't something everyone is afraid of and is viewed differently by different people. Not to get all philosophical here, but essentialy I don't think executing Tim McVeigh did anything to Tim McVeigh, per se, just ended his existence. Sure, it took him away from society, but so does putting him in prison for life. I'm sure the amount of money it takes to execute someone, past appeals and all may be comparable to what we spend having them in a maximum security prison. (Though I haven't seen any figures on this.)
That isn't even to mention the fact that sometimes many of the people who do commit the WORST crimes never even get the death penalty, some of the worst serial killers we've had in America have just ended up with life in prison. I'm not going to judge who should be executed or not, since I don't particularly believe in it. But I would bet that by the standards we hold, many people who have committed crimes like this one or worst sometimes live long lives behind bars. Whether or not that's a walk in the park or not, is up to whatever prison they are in. I'm tempted to think if they are a child molester or serial killer..NOT.

I agree with your warning. But I covered this trial from Gardner's arrest and extradition through his sentence in a St. George courtroom. The racist overtones of this vicious, senseless murder were NOT squashed by the media. I'll be happy to forward my file if you wish.
BTW, I think Gardner is a sociopath. The most ironic factor is that his mother was a sheriff's deputy in Michigan and helped him evade the law.

This was a hate crime involving torture.
I think the women that assisted in the bleaching process attempting to destroy DNA evidence should have received much stiffer penalties.

Let's not forget that those fine, upstanding women are still living in the area, passing bad checks. What lucky friends and family they have...I wonder where the parolees have gone, since their release? My comment earlier is that the major news media did not cover this as a "hate crime", which it most certainly was. It is getting press now because of the impending execution, but it certainly didn't make nationwide news in my opinion.

My bio father pretty much grew up in the Sugarland Penitentiary in Sugarland Texas, even he would've applauded that con job of a "repentance" statement and he was one of the best.
