No suspension for Clemson linebacker McDaniel
Sophomore was arrested in June
CLEMSON Clemson linebacker DeAndre McDaniel is not expected to face any game suspension for his summer arrest on charges of assault and battery of a high and aggravated nature.
According to sources familiar with the situation, athletic director Terry Don Phillips and university president James Barker have signed off on coach Tommy Bowden's recommendation not to suspend McDaniel.
An announcement is expected Friday from Clemson's athletic department. The No. 9 Tigers open the season against No. 24 Alabama on Saturday at Atlanta's Georgia Dome.
McDaniel was arrested June 21 after an altercation with his girlfriend at his off-campus apartment. Abra Weeks, 19, charged that McDaniel choked her, punched her and shoved her down a flight of stairs.
McDaniel agreed to pre-trial intervention, a program for first-time offenders that wipes away offenses upon successful completion. Weeks endorsed PTI, and the 13th circuit solicitor signed off on it last week.
According to the sources, Clemson will expect McDaniel to stay free of trouble and abide by all the terms of PTI or face definite suspension.
McDaniel is competing with fellow sophomore Scotty Cooper for the starting position at strong-side linebacker.

Addendum...Three uncharged witnesses refuted part of her story. Police failed to attempt to interview the witnesses and the alleged victim failed to provide requested information to the administrative hearing or make an appearance...stay tuned for the rest of the story.

Clemson as a university does not have the same standard of proof that you would see in a court of law. Playing football is not a given right, if the university deems that the player did not act in the best interest of the school, then they have an obligation to discipline the individual. But, apparently, Clemson is more concerned with winning games. Even NASCAR hands down penalties for actions detrimental to the sport without asking for a DA's evidence and conviction. Of course, if Tommy looks to his dad as an example, then it is not surprising that this player is still playing.
Even the Clemson administration has set a couple of examples....(1) track coach keeps his job after stealing funds from the school and (2) the Clemson president asked the CFO to not disclose money that was set aside....the Enron Accounting standard.

First off, the Garcia charges are a lot different than the charges brought against this player. Would you compare jaywalking with a hit & run by vehicle? I do not agree with how Garcia has acted but, if there is anyone who has never broken the law by drinking underage, then they can talk all they want. However, that is a lot different than physical abuse.
Clemson offered this kid a chance to get a free education and play football. If there are any standards associated with accepting that scholarship (which there are), then Clemson has every right to suspensd the athlete with or without a mountain of evidence.
If the player wants to sue, have at it. Remember, it is not an annoited right to play football where the athlete could prove harm if suspended. Students can be expelled in college for evidence that would not hold up in court, it is a totally different set of rules.

If he took an offer of PTI, there is an assumption of guilt.
The question here does not pertain to McDaniel, but to Tommy Bowden, especially since he puts himself in a hypocritical situation in that he did a public service add against domestic violence.
At a very minimum, gulty of the charge or not, Bowden should have at least suspended him for a patsy game, you know like Spurrier did for Mike Davis??? At a minumum, McDaniel was involved in an altercation in which the police were called and in light of Bowdens statement on the PSA, he (Bowden) dropped the ball and gives the impression that winning is the most important thing.

USC fans are just upset because DM is a good player and they don't want him to contribute to what could be a historic year for Clemson.

This is not a Carolina/Clemson issue like many people like to make it out to be (even if it was, underage drinking, which I'm sure 99% of you have done, is in no way, shape, or form equal to or worse than beating up a girl half your size). This is an ethical/moral issue. I think its pretty obvious that McDaniel's hands aren't clean, or he wouldn't be entering PTI. While its not technically an admission of guilt, its just something you don't get into if you're innocent. If there was no evidence to indict or convict him, why would he accept PTI when he could get off clean?
Basically, the kid should be punished in some way by the University, which has made it glaringly obvious that football is more important. If this kid was a walk-on RB you can bet he'd be suspended or kicked off the team. Instead, he's being given a free pass b/c he's fighting for a starting spot at a position with little to no depth in a crucial year for Clemson football.
I've known several girls throughout my life that were assaulted in some way by a friend, boyfriend, relative, etc... and in more than one case it was by a star athlete (none at Clemson or USC) who ended up getting off clean b/c he was an athlete. In some cases it wasn't the first or last time the player assaulted a girl. Its pretty pathetic when one of the major universities in the state looks the other way to protect its football program. They could at least suspend him for the Duke or Citadel game, just to make a symbolic gesture when it doesn't really matter if he plays or not.

Grow up. The banter back and forth is on the same level as elementry school kids arguing on the playgroung. My dad is smarter, bigger..... or your mom is soooo ugly. The way most schools handle disiplinary problems is an embarassment to the alumni. Clemson and Carolina are not exceptions. What shade of gray would you like to werar today?

As for the story above, like many before me have posted, he HAS NOT been proven guilty, and he HAS accepted PTI, which does suggest he is accepting some responsibility, however that does not mean he threw her down stairs or punched her in the face. Last time i got punched in the face I didn't walk away smiling like this young lady, and she certainly wouldn't be smiling if she "got thrown down stairs." Thrown down stairs? Thats a BIG deal, you don't just get up and walk away smiling after you get thrown down stairs, i don't care who you are, that f'n hurts.
So to all you "tater haters," I truly wish you the best of luck tonight, but because DM is playing does not mean there is a fault in the university for not punishing this kid. He had never gotten into trouble before, the facts are all in the gray area, and the school made a decision off of the facts they had.
