Attorney calls it a mistake; colleague calls it dirty politics

SUMMERVILLE — State Sen. Randy Scott spent the night in the Dorchester County jail Saturday night on a charge of driving under the influence, and a debate has begun about whether the arrest was politically motivated.

Scott's attorney Sunday called the charge a mistake, while a fellow state senator said there's little doubt politics was behind the arrest, timed just a few weeks before Scott is up for re-election.

A Dorchester County sheriff's sergeant pulled Scott over at 11:37 p.m. Saturday in front of a Froman Drive house because he was driving erratically, said 1st. Sgt. Michael Miller. Miller said Scott, 62, was taken to jail when he failed certain field sobriety tests.

He was released from the Dorchester County Detention Center around 7 a.m. Sunday on a $992 personal recognizance bond.

Scott did not return phone calls Sunday night, but his attorney, Reese Joye, said the results of the field sobriety tests were affected by the fact that Scott lost a leg in a hunting accident as a teenager. Scott now wears a prosthetic leg.

"The dashboard videotape will reveal the normal patterns of an amputee being forced to walk heel-to-toe and to stand on one foot in the rain," Joye said.

Scott was an auctioneer that night at a church auction, then went home for a little while before going out again to check on some of his campaign signs.

Scott was pulled over in the driveway of a supporter, Joye said. He said Scott told him that he blew into the Datamaster, which determines blood-alcohol content, three times and that each time the results came back as zero. Scott also told his attorney that he was denied a blood-alcohol test and access to an attorney.

Joye said late Sunday that he was trying to gain access to the state-mandated videotapes of the traffic stop and the Datamaster test results.

"Both of those videotapes are required by law, and if they are not immediately forthcoming, then we can assume this incident was politically motivated to damage Scott a few weeks before an election," Joye said.

Scott, R-Summerville, will face former state Sen. Mike Rose in the June primary for the District 38 Senate seat that extends to Dorchester and Charleston counties.

"It's sad he brought this on himself, his family and our citizens," Rose said. "My opponent's behavior will not distract me from my positive campaign, which is about what I do, not what my opponent does."

Rose also questioned Scott's behavior while he was behind bars.

"My greatest concern is whether he demanded special treatment to get out of jail early," Rose said.

Rose later said everyone is innocent until proven guilty and that Scott will have his day in court.

Joye said his client did not demand special treatment and said that political blogs and reports stating otherwise were part of a political smear campaign.

Dorchester County Sheriff Ray Nash "is a big supporter of Mike Rose," Joye said. "Anything Mike Rose is hearing is coming from loose lips in the sheriff's office."

The sheriff's office did not return calls seeking response to Joye's comments.

Sen. Robert Ford, D-Charleston, said Sunday that he had heard about the arrest, and though he didn't know the details, there's no doubt in his mind that the arrest was politically motivated. "It sounds like a political setup," he said.

Ford said no other public officials are taken to jail on a DUI charge weeks before an election. He said it's idealistic to think that's because they're not drinking and driving.

"They've never done it before," Ford said of arresting politicians. "If they're going to do it for him, I'm demanding they do it for everyone in the future."

Miller responded to Ford's comments by saying that it was simply an arrest of someone accused of driving intoxicated. He said more details will be available in a police report released today or Tuesday.

Some of the only reasons that a follow-up test would be warranted are:

1. The blood alcohol was extremley high and needed to be monitored to ensure that it was not rising, and was coming down.

2. The machine had some form of error, which required a second test.

If a person is arrested for DUI and requests his/her own test, a law enforcement officer must provide affirmative assistance. This being said, an appropriate course of action would be to transport the accused to the nearest medical facility so that they may have have a test completed at their expense.

I am sure that the full story is not out. The SLED website to view DUI video's is not immediate. Reese ought to know this.

The entire state of South Carolina uses the BAC Datamaster machine. The "breathalyzer" is not used here. The Datamaster is a reliable machine, and actually benefits an intoxicated person more than having blood drawn. A blood draw reading will always be higher than a breath test reading.

On another note, it does not look like Dorchester County makes that many DUI arrests. Since January 1, I count only 5 arrests, not including Scott's. The link to SLED is: http://services.sled.sc.gov/impliedconse...

Mr. Joye's comments about political motivation are certainly funny. As i recall Mr. Joye seriously fought strengthening the state DUI laws so it would help him more to have a friend in Columbia. Has Joye donated to Mr. Scott's re-election campaign? Now that would show political motivation if he or his family had made large donations.

.....uh, doesn't the DUI machine require another sample when the defendant refuses to blow adequately trying to trick the machine? If there was a reading given, even if it were zero, there would be no additional test.

Also, the attorney is right that all Datamaster test should be video'd. They are available on line through SLED with the code number given to the defendant at time of arrest on his ticket. Since "it was a set up", give us the code and we can all watch it for ourselves.

I think the PC can FOI it and we can all watch it.

If gambling was legal I would bet you that this guy is really drunk on the videos.

Seems like Senator Ford is aware of legislators driving drunk and being allowed to do so by law enforcement. I'd like him to give us some more details about that. I'd also like to know why Senator Ford thinks it's kosher to allow legislators to drive drunk.

To me, Senator Ford's comments imply that political candidates commonly drive under some level of influence of alcohol before elections, that law enforcement know about them driving that way, and that law enforcement have selectively not charged the candidates in the past. That's good political speak...plenty of room to wiggle.

Duke Lacross players! Need anyone say more? I thought our society believed innocent until proven guilty in a court of law. Doesnt Sen Scott have a negative history with Ray Nash the Sheriffs Dept from his County Council days? Interesting. Mike Rose should take solace that the Senator spent the night in jail and that proves he didn't use his position to get him out, but it may have gotten him in. Rose is an attorney, but his comments broke the constitutionally given right of innocence until proven guilty. Wouldn't everyone love to know when Rose found out about the arrest? I would guarantee it was before midnight saturday night.

How many DUI arrests has this officer made.... I am sure Nash hand picked him for this task since he is falling out of favor with most of his deputies. It is also FOI to check this Deputies prior arrest history to see if this is one of his "Normal Duties"... easy enough to find out. Chris Pia.. take that one for action.

Mike Rose had his opportunity in the Senate and was chased away due to his mindless political games... Does his campaign literature show that his "Experience" was soundly defeated by Bill Branton..... uhhhh NO..

Rose had a snowball's chance in Hell of defeating Senator Scott in a legal campaign.. so why not get in Bed with a Proven Corrupt Sherriff to lower the temperature.. how many hundreds of thousands of dollars have dissapeared from Dorchester County under his watch.

I am just surprised this happened this week instead of a few weeks from now... Nash even screwed this up!

For the record... all of these neagative comments are coming from the Same 13 contributors to Mike Rose's campaign. A million dollars worth of NEGATIVE Publicity on $3,000 worth of Campaign contributions.

Some of the regular contributors take a more reasonable approach to the story.

If I were a cop, I would rue the day that I had to ticket an elected politician...damned if you do, damned if you don't...what a pain for doing your job...and God help you if you used any legal and moral discretion. There are consequences to sin and consequences to doing the right thing.

I find all of this very interesting. I am going to withhold judgment on the charge until all of the facts are in. However, I am going to comment on the obvious. The timing is very suspicious to say the least. Mr. Rose wants to run a 'positive' campaign but his comments don't reflect that mindset. Personally, I would hire the best attorney I could find. It is ludicrous to do less whether you are guilty or not. I choose the best I can afford for my house, car and family. Why not do so when seeking legal counsel? This is the same county department that arrested an elderly man for disorderly (I think that was the charge). That case lingered for 6 months before being given to the solicitor who said within a month that he should not have been arrested to begin with. Is the sheriff's department targeting the old and handicapped? Is this case going to follow the same path as the other? If so, one would have to wonder the real reason behind this arrest. As I reflect on the past comments from Sheriff Nash, Mr. Rose and others about how they are against the 'good old boy' and then study their actions, I am beginning to wonder if they are not doing exactly what they profess to be against.

As a mom of a Summerville High School student who was returning home from Prom close to that time, I am grateful that our officers were out there looking for drunk drivers.

Did Mr. Scott think about maybe that's why they were out in full force?

Sounds positive to me Mike. Whatever happened to innocent until proven guilty or do you as an attorney no longer follow that Constitutional right? Also, how would you know about his behavior behind bars? If it were me running a POSITIVE CAMPAIGN and my opponent was arrested my only comment would be, "I'm sorry to hear that, however, I will not make any comment until my opponent has had his day in court."

Nice try. Deflect what looks like at least an apparent blunder by Dorchester County and try to say that if Randy Scott is vindicated, it must be LC's involvement in Nash's office. Wow, is that a stretch. Lets give you a field sobriety test!!!

Guilty or not, Mr. Scott will not be getting my vote during his re-election run. He should have been at home responding to my email rather than checking on his political signs that late in the evening.

However, he is not alone...no incumbent in Dorchester County will receive my vote, even if I have to cross party lines to make sure of it.

I love all the Scott supporters comments about Nash and being politically motivated. There is no crime in Dorchester County so all of the officier's are instructed to look for a politician's car, pull them over, and fabricate a charge. Mistakes may have been made to buy into this mindset is just dumb. And Robert Ford, who cares what he has to say about it?

If Nash was a Scott supporter what who would these people blame then.

I am really worried about Chris Pia and his followers. Nash will be gone at the end of the year and they will have nobody to blame for every little thing. What will they do???

Chris, in a few of the posts (when your not frothing at the mouth about Ray Nash) you seem to be the kind of guy that would stick up for the deputies with "boots on the ground". How about sticking up for the deputy that actually made the stop here.

This guy is getting hung out to dry by all the conspiracy theorists.

Show some consistency here so it does not look so obvious that you would do anything to get your guy Knight and his cohort elected.

Hey, notafan, for a 'mindset' that 'is just dumb' just read your 9:47a.m. post. I can see how good old boy Randy was taken care of Saturday night. No blood test, 3 times he blew a zero, and he still gets locked up.

If it is found that he did blow zero, and he did not get a blood test, then he should be vindicated. No good old boy system, just the law. But I will bet if that does happen, it won't be front page news.

I would reserve judgement until the officer's video and datamaster results are released! Certainly sounds fishy though! If Scott had just come from a church auction that would seem to rule out that he drank any alchohol as he states! This could go either way, but I don't put anything past law enforcement officers making things up anymore as we have all seen!

I can't wait until the election is over but I am worried about Chris Pia. He obviously has a agenda against Nash and Boatwright. Hey Chris you don't always need to drink the kool aid that LC Knight gives you.

And Arthur Bryngelson is a joke. He wants the county to elect a real estate agent as the town auditor. Does a real estate agent really have the knowledge and expierience to run the auditor's office????

Chris Pia I know you are a huge Knight supporter, do you also support the Lafond, Horne, and Scott contingent? All of these individuals are part of the good ol boy system. Has anybody noticed there signs are all posted together???

So, these people want a real estate agent that has been out of college for less than five years to head up the auditors office, a real estate attorney for state house rep, and another real estate attorney for soliciter.

These are the same people who want a Sheriff that is close to 70 years old and has been retired for several years. Can anybody say out of touch??

No wonder Dorchester County is headed down the tubes. I just hope the voters can see through this garbage and actually vote for people that are qualified for the position they are running for.

Until all the facts are out, I will not pass judgement. Mr. Scott is innocent until proven guilty. There are just too many questions surrounding the incident.
Mr. Ford's comments cracked me up. If he was quoted accurately, it sounds like normally, if state senators drink and drive, it is overlooked.
Mr. Rose's comments were odd. From what has been released, we do not know what went on while Mr. Scott was locked up. What does Mr. Rose know about his actions during this time and what business is it of his anyway? It sounds like someone from inside was feeding him information which puts a cloud over the entire situation...

It's this kind of tribal warfare in politics, both locally and nationally, that keeps me out of it - you have to be in one camp or the other - and the issues and problems facing the community and the country get lost in the confusion.

Of course, it's been that way since Jefferson and Adams, but it was always our strong moral core that kept us roughly on course. If we continue to eschew Judeo-Christian ethics, we will be lost.

Are you f'ing kidding me?? THIS is Ford's position??? I guess it's all a question of degrees of stupidity and corruption. It's hard to smell someone else's stink when you're sitting on pile of sh*t yourself.

Sorry, but I'd prefer to see my elected officials held to a HIGHER STANDARD than for them to assume drinking and driving is OK (for them) and that the real problem is that they are either all above the law or they all aren't.

Don't worry Boss Hogg-Ford, I'm sure Sheriff Roscoe will let YOU off next time you get pulled over drunk off your arse.

It's obvious that the smell of rat is in the air, but it's too early to tell from which side it's pungent odor comes. Unless someone does some fancy footwork and fast, however, we may not have the facts before the election.

On the surface: Rose contradicted himself even as he said he wouldn't comment negatively, and a man that blew a zero three consecutive times spent the night in jail.

Shame on everybody here that believes what this news rag is reporting! chrispia you seem to have a knack for finding things on the web, how about finding the tape of the arrest and judging for yourself.
To say this was politicly motavated is just dishonest, and you have shamed the deputy and any other offical that was involved with this. You should owe them a debt of gratitude for being out there, and taking drunks off the street!
Lets wait for the vidoe tape before casting any doubt on this.

Usually You ask the person if they have a medical condition that would prevent an individual from doing the test.I think Mr Scott probably should not have been determined drunk on that test.

Just doesn't add up.

Something does'nt jibe about the story correct, but then again what if Mr. Scott was really drunk and the officer was correct? The only thing I can say is I'm getting tired of this BS, who do you believe anymore?

The report now says Scott was not even driving. He was parked in a private yard when the officers came up. Nash is a Boatwright and a supporter of Mike Rose according to the report. We all want to see the audio and video of this. Ray Nash ought to hire more professional men who know how to deal with someone with a handicap. I hope Mr. Scott is set free on this and that the officer has to pay all the lawyer fees for Mr. Scott.

There has been no truth in the whole Ray Nash regime!!!! How much did he protest when County Council ordered the Audit... Called it a Witch Hunt.... Blamed County Council for Wasting Tax Payer money.... was it a Witch Hunt.... NO....

Advice for Councilmen Hargett and Murphy... check your Rear View mirrors.. these thugs will stop at nothing... your MUG could be next.... All they need is the word of the "Good Deputy"... facts are Irrellevant.... Thank goodness we only have 8 more months of this kind of Crap from our Sherriff's office!

Mike Rose probably found out because the P&C woke him up from his bed to give him their version of what happened. I don't see the time on the article but you can bet it was probably early in the morning when they called him. Please don't be fooled into thinking that the next sherriff will be better, especially if it is an old democrat like LC Knight. A democrat all his life except when he's running against a republican sherriff that he know's he can't beat in a general election. Now that's some fodder for the cannons.

It is amazing the assumptions people make. All officers know the requirements for arrests for DUI, including video taping. To charge that the officers, the sheriff, and other politicians are all in a grand conspiracy, without proof is both irresponsible and outrageous. Mr. Joye should be reminded he can not under the law serve as both a witness and counsel representing his client. He has made himself a witness through his statements and the prosecutor could call him, disqualifying him as counsel. This is not a conspiracy, but an attempt to transfer blame for bad behavior to those trying to do their jobs. Unfortunately, another woman may be involved. This is a family tragedy that has regretably forced itself into the public eye. People may forgive bad behavior, but not when they try to shift the blame on to innocent others. The facts of this case will speak for themselves. Those that try to justify bad behavior on any side will ultimately be held accountable too.

So Mr Ford apparently thinks it alright for our lawmakers to drink and drive? As he states,"Ford said no other public officials are taken to jail on a DUI charge weeks before an election. He said it's idealistic to think that's because they're not drinking and driving." "If they're going to do it for him, I'm demanding they do it for everyone in the future." I know of no one else who gets a free ride when drinking and driving. Is this a perk of being a lawmaker? If they make the laws, then they should adhere to them , just as the rest of us do!!!

Just a few things about some previous posts:

1. Just because a drunk can use a phone doesn't mean he's sober. Ever heard of a functional drunk?

2. Of COURSE he repeatedly claims he was innocent. He was talking to his WIFE, who was about to put the hammer down on him. This clearly wasn't the first time she had to listen to her idiot husband try and talk his way out of a situation caused by his own stupidity.

3. Also, remember the first rule of deniability: convince YOURSELF that you're innocent. How do you that? Keeping saying that you’re innocent, over and over, to yourself and anyone that will listen.

4. He was clearly up to something. He told his wife "I was just riding around." Right. At 11:30PM a Saturday night. His attorney later released a statement that claimed he was out "to check on some of his campaign signs". Again, at 11:30PM at night?? Guess when he had some time to think about it he had a more concise (although really not that believable) story about what he was doing.

5. Don't be confused about why he was angry. He wasn't indignant that he was setup, but rather that he wasn't given the special treatment that he feels a man of his stature so clearly deserves. He firmly believed that he should have been let go, regardless of his condition, because of who he is. When that didn't happen he had a tantrum and turned this into something political.

Regardless of how drunk he was, he WAS drinking and driving, he WAS an arrogant jackass during the arrest, and he clearly has the intellect of the spanish moss growing in my yard. Please people, stop putting people like this in office.

Oh and ChrisPia, you might want to talk to your doctor about increasing your dosage. The meds don’t appear to be helping.

Entertainer Kimo Kahoano, actor Daniel Dae Kim, and state representative John Karamatsu were also arrested for driving under the influence. Some Mililani residents believe it's a major setback in trying to impress upon kids the importance of driving sober.
