State Sen. Randy Scott, R-Summerville, was arrested on charges of driving under the influence Saturday night.

COLUMBIA - The Dorchester County Sheriff's Office released this afternoon a copy of the incident report that describes the arrest of state Sen. Randy Scott on a drunken driving charge.

According to the report, Deputy Chris Freshman observed a vehicle driving in a "very erratic manner" around 10:50 p.m. Saturday in Summerville. The deputy ran the tag and learned that the vehicle belonged to a state senator and he requested a cruiser with a camera be sent to record the stop.

Sgt. Randy Botten detailed in the written police report several field sobriety tests that Scott, R-Summerville, was unable to properly complete.

Botten wrote that once at the station, Scott "berated and at sometimes appeared to be intimidating deputies."

The results of Scott's Datamaster tests, which determine blood-alcohol content, also have not been made available.

Scott's attorney Reese Joye, who released a statement late Monday afternoon, told The Post and Courier Sunday that Scott took the Datamaster test three times and that each time the results came back as zero.

The newspaper is investigating claims by Joye that the arrest was political.

Check back for updates.

How do you know he blew a .000 "a couple of times?" Where you there? Oh, his lawyer says he's innocent, yeah ok.

In the last almost 8 years, the arresting officer has made 15 DUI arrests (Information obtained from SLED website). This officer is also nominated for the America's Most Wanted All Star http://www.amw.com/allstar/2008/nomin...

The man said he was not drinking and the test will hopefully prove it. Sgt Randy Botten looks like someone who enjoys giving a person with a disability a hard time.

The article says that the report states.... The report is written by the officer. There is not going to be anything written in it that would be beneficial to the accused. I, like most, would prefer to hold judgment until real evidence is presented. Until then the accused is innocent. This seems like a rerun of other events concerning the Dorchester County Sheriff's Office. That leads me to be more cynical about their statements now.

The people have demanded the tapes, and the P&C got them. Good deal, now we may learn some of the truth.

The first officer requesting a backup with a video camera seems like a good move, this one could be legit! The videos and test results will tell who is for real in this one! I cannot imagine that the deputy would make up something like this, all the problems going on in the police ranks granted, but he would'nt pull something like that with a state senator and with the video running! At least I hope not!

Just saw the video on nightly news.

This guy was swerving all over the road, was driving without headlights on in the evening, and even ran a stop sign.

Sounds like the officer had a few clues to think the guy might be impaired somehow - drunk or stroke or stupid?!?.

Sorry I missed the evening news and the video.I've been sooo
entertained by these comments.A police officer does his job and it's a conspiracy! These are probably the same people who
ask where are the police when you need them? I live in Dorchester County and thank God that we have a police force that sees a drunk driver as a criminal and not a politician.
The officer did the right thing if he thought that Senator Scott was intoxicated.Do you idiots really think that anyone would try to fabicate such a story? Really now, you guys are more entertaining than robert ford.

I gotta give credit to Deputy Freshman. Most LEO's, after running the tag and discovering it was a state senator, would have left him to go on his merry way. Who needs the hassle?

"The deputy ran the tag and learned that the vehicle belonged to a state senator and he requested a cruiser with a camera be sent to record the stop."

Seems odd he would request the video car AFTER he found out the car belonged to a state senator. Requesting a video car was the correct move, but he should have requested it when he ran the tag number.

As I understand it, Mr. Scott left a shopping center and almost ran into a ditch. Than observed driving down the highway all over the road. My question is, Why did this officer allow Mr. Scott to continue driving after witnessing this type of behavior? It appears to me that someone at the auction witnessed Mr. Scott drinking and reported it to either Rose, Nash, or the DCSD. Why not pull him over right then and there then request a back-up car with video. Why risk someone getting hit head on or someone just walking their dog. This sounds very fishy to me.

Just watch the video. And listen to it. He didn't get the alphabet right saying it in order (not even backwards) and listen to his comments to the officer whose car he was riding in. (I think it was WCIV who played that part.)

Mayor, the statement about the .000 three times came from the man's attorney. He may be a bit biased. Also, lawyers are known to lie every now and then.

And I took your advice, I had a beer and I feel much better now. Thanks!

It would seem that prettyy much everyone that is against Sherrif Ray Nash is a DRUNK.Look around folks, Randy Scott, and those that he supports! drunkard liars! You think I'm wrong? After denighing he had anything to drink, he now says that he had 2 small cups of wine. What happened? Did he get sober enough to rememeber? Think about it folks. If you never want to worry about getting a DUI, then these are the guys to put in office for Dorchester County.

CitizenAdvocate (anonymous) says...

Trying to create conspiracy theories to divert attention from a clients bad behavior is really a tawdry legal maneuver. Having been at the same breakfast that Reese Joye says he attended, I saw none of the behaviors he claims. Further, Mr. Joye should be reminded he is making himself a witness, which means he can not be both a defense counselor and witness. While officers can make mistakes, the tapes would seem to support the officer, not the defendant here. Impuning the integrity of good officers, berating and trying to intimidate them does not speak well for the defense. Blaming others for your own bad behavior and being unwilling to accept responsibility for your acts, especially from someone who is suppose to be an example to our young people, is not acceptable. People should let the facts speak for themselves, quit defending abhorent behavior, and demand accountability.

He ran the tag to see who it was??? It is a STATE SENATE Tag... HE KNEW who it was!!! Mike Rose and Ray Nash Knew who it was.... There was no swerving on the Video.... maybe a Georgia Roll at the sign... who has not done that...

I can not say the Alphabet Backwards right now... Everybody all together try it!!!

Some of you need to reread the article. He did not "blow a .000 three times. The article statest that he was unable to complete the test properly. His attorney is "spinning" that to mean that he passed the test.

Why are you dragging Mike Rose into this? Give me a break! You conspiracy theorists need to clear your heads. Just because Mike Rose is running against this guy you jump to contusions (not a typo) that he could have set this up or that Ray Nash has it in for this guy.

Has it ever occured to you that the guy was actually DUI?

No... Read Mike Rose's Comments... He knew the full story hours before it was released.... Scott and Nash go wayyyy back from when NAsh was cheating the taxpayers years ago. Luckily Mr. Hargett and Company kept up the fight to uncover the corruption and THEFT that has taken place! Who told Rose.. check Nash's phone records and you will know!

Again- Bottom Line: If the deputy KNEW Senator Scott was drunk, and he KNEW Senator Scott was tricking the DataMaster, and he KNEW he smelled alcohol, and he KNEW his eyes were bloodshot (they didn't appear to be in the mug shot), and he KNEW he was driving crazy- Why not do a blood test to remove all doubt. The blood test would be the confirmation of guilt. Unless....the sheriff was afraid of the confirmation of innocence? Also, a drunk man would have been fighting the handcuffs....Denied an attorney, denied an impartial Trooper, denied his ability to prove his innocence....I think I would have been a bit fussy in jail by the wee hours too.....

He did not have a spot light and was checking on his signs. He should have used a flash light to shoot light into the yards. That's a big difference than being drunk. The person should gotten at most was careless driving. Knowing your ABC's is not required to be able to drive in SC. You don't even have to know english to drive in SC.

This was a set up.

Checking on his signs? At 11pm? Give me a break!
He admitted to having two drinks on video. He couldn't even stand up without leaning on his truck!
Asking for a video car WAS a smart move.
Kudo's to the guy that stopped him.
Others would have made the next right turn and ignored the obvious indicators of an impaired driver.
Apparently knowing your ABC's is not a requirment for a state senetor either.
The data master read .000 because he did not blow hard enough or for the required amount of time. (I'll refrain from the numerous jokes that brings to mind)
....last but not least....he played the handicap ticket (didn't work), played the "do you know who I am" ticket (didn't work), then tried the "I'll have your job" ticket, and look where his efforts got him!
I don't know if he is on Knight's side, Boatwrights side or whoever....I don't care, a drunk is a drunk.
and what the hell is a DCSD?

Impartial Dorchester County HP - you're kidding me! I know of one - count one that is not supporting the candidate Scott said would fire the officers that were only doing their job. I'll be surprised that if Knight wins that these guys don't lose their jobs for something not so obvious! Anyone remember the antics of Carl Knight? Scott has already been noted as demanding the release of people held in the Town jail to his custody.
As for the leg requiring him to prop himself - look at the Youtube video of Scott standing and speaking at a Republican breakfast - no prop and no wavering then.
Why all the conspiracy of "mean ol' Mike Rose?" Scott has already said he would "kick his *ss" in the election and at least one Town official tried to bet that Scott had the race already won in a landslide months ago!
Scott has already publically stated that the "senate ain't the greatest job in the world anyway" so why all the consternation about a set-up if it really doesn't matter?

wclcal55 - All Scott supporters are "drunkard liars"? For your info I support Scott and have never drank. Don't call me no F---ing drunk. If any one was drunk on the videos it was the officer giving the test because he even messed up on give Mr. Scott his rights. Watch the video and pay attention to the officers speach. After years of giving people their rights he still can't do it without messing up. Watch the very beginning and you will see what I mean. So get off you F---ing high horse, you Nash,Boatwright,Rose supporter. You are not all mighty so get a life and put your feet on the ground instead of your head up your ass.

Could be he was drunk and got caught! Could be his good ol' boy network is failing him. Could be he can't handle wine if two glasses made him stumble over the alphabet and counting. Could be he should represent all taxpayers in Dorchester County not just a select few.
Why was he visitng a friend who had been in bed for 2 hours and who did not know he was coming to visit?
Who was the woman in the car that was reported or has that been dropped? Why was he sitting in the BiLo Shopping Center with his headlights off?
