Ex-Berkeley roads director to appeal firing

Gathers and former project supervisor in department face conspiracy, other charges

MONCKS CORNER — Former Berkeley County Roads and Bridges Director Cornelius Gathers is appealing the county supervisor's decision to fire him last week.

Supervisor Dan Davis fired Gathers and project supervisor Henry Stewart on Friday, a day after both men were arrested on charges that they ordered county employees to pave private roads, including Gathers' own drive, and then tried to cover it up.

Stewart and Gathers are charged with conspiracy and official misconduct of a public official. Gathers also is charged with breach of trust with fraudulent intent.

Davis said the county received Gathers' request for an appeal Monday. It does not give the basis for the appeal. Neither Gathers nor his attorney could be reached for comment.

Davis said he fired both men before the resolution of their case because the State Law Enforcement Division investigation showed they violated county policies. "There was testimony and statements made that would lead us to believe there were violations of the county's personnel policy."

Fired employees have three working days to appeal. A grievance committee of five County Council-appointees serving three-year terms will hear the case. The committee must set a hearing date within 10 days of the appeal.

Stewart, 64, had not filed an appeal as of Monday. The St. Stephen resident has worked with the county since 1977. He has spent the last three years under the state's Teacher and Employee Retiree Incentive program, which allows retired employees to continue working while accumulating retirement.

A woman answering the phone at Stewart's house Monday said he was unavailable for comment.

Former Supervisor Jim Rozier hired Gathers, 44, in February 2006. Gathers, a former Department of Transportation and Charleston County employee, was making more than $80,000 a year at the time of his arrest.

Warrants accuse Gathers and Stewart of ordering employees to pave six private roads since April 2006. Stewart is accused of falsifying records to help them conceal the work.

Gathers told The Post and Courier prior to his arrest that he did not have county employees do the work. He said a private contractor did the work as a personal favor.

Boy that's amazing. Everyone is presummed innocent until proven guilty BUT...
Let this be a warning to every employee that if you use your companies inventory, people, and equipment to benefit your pocket book you can be charged with breach of trust.
Next complaint will be they fired them because they were black! Correct me if I'm wrong but his predecessor was fired for about the same reason?? AND he was white? Don't go there please.

That is just unbelievable,, how are you going to steal from the company and then appeal the firing.... that is just incredible... I was trying to have the benefit of the doubt about stupid people in the world, but everyday it gets harder..... WOW.............IF I WERE A DOCTOR THE FIRST CURE I WOULD MAKE WOULD BE SOMETHING FOR STUPID..... THEY NOW HAVE SOMETHING FOR UGLY CALLED PLASTIC SURGERY, BUT AS USUAL STILL NOTHING FOR STUPID ...... ITS AMAZING

Right to work state - they can fire them for any reason, or no reason. Having worked for Berkeley County I would say that being fired might be a good thing.

A number of years ago Mr. Clyde Umphlet went to jail for using Berkeley county employees to work on his private property! Guess they forgot about that - or thought they had a better plan for beating the system. Mr. Gathers was not here then, but Mr. Stewart certainly was! And now Mr. Gathers is appealing his firing?? What a loser!

I am shock at reading some of these comments. Some of you should be shame of yourself for even posting such racist comments. A crime is a crime no matter what color the criminal is. Race should not be a factor into rather or not they did it. Their color also should not be a factor as to how much money they make. Hell has not furry when a person is full of hate. I am from the St. Stephens community and yes these two workers have some serious issue that they need to deal with because in America, you are Guilty until proven innocent. Ever heard of the Constitution, "Due Process". Their is no excuse for what these two people have been accused of and if they did do these things, then yes they need to be fired. Regardless of their color.

"Psumpter", you are absolutely correct. Based on the articles I have read concerning this issue, race was never mentioned. This article gave no reason to consider race as factor in the issue at hand. This phenomenon confirms what I as a minority in South Carolina have always perceived. Race is always an issue here though seldom voiced in a professional setting due to legal leverage provided with discrimination laws but never the less it is very heavy on the minds of the Majority and race influences every aspect of their lives and the decisions that they make which inherently affects every aspect of my life as a minority in a very negative way in many instances. Oh, there is one instance where race is generally not an issue and you are considered an American, when it comes to military service over in Iraq and Afghanistan. I believe Mr. Gathers is a veteran of Afghanistan and deserves the benefit of all the "due process" afforded to him as an American.

To psumpter and MinoritySouth: Unless I'm mistaken, only one person has referred to race on here today. That would be flyboy68. Pay him no mind as he has proven himself to be unstable on other posts. This not a race issue, but a matter of right and wrong. Mr. Gathers does deserve the same treatment as any citizen in this country. If this case goes to trial, then let a jury of his peers decide his fate. And to you, flyboy, who apparently doesn't like the South, for your info most longshoremen clear the 6 figure mark.
