KIAWAH ISLAND — The company wanting to build 50 homes on Capt. Sam’s Spit is suing the island’s homeowners association to get back a deed to property along the path of a proposed access road to the development.
The lawsuit decision could stymie plans for the development, or require developers to move the road, putting the fate of acclaimed Beachwalker Park further in jeopardy.
The road is planned to run between the scenic park’s parking lot and the beach. Opponents have been concerned that it would run along an emergency vehicle easement through the parking lot.
The spit where the controversial development is planned is a narrow, wildlife-rich reach of exposed land on the Kiawah’s western end.
