Video shows Burke Middle student striking teacher

Charleston police released a videotape this week showing a March 13 incident in a hallway at Burke Middle School in which one student was charged with simple assault against a teacher.

The video shows two students (in the foreground at first) getting into a minor scuffle, then one is later separated (in the background) by a teacher.

The student was charged with simple assault after he struck teacher Stefan Whaley in the face, but the student's lawyer said recently the case has not been pursued to date. The student has returned to a different school and is doing 20 hours of community service supervised by police but isn't facing any charge in Family Court, his mother said Tuesday.

The Post and Courier requested a copy of the video just days after the incident, but the Charleston Police Department did not release it until Monday because it chose to blur the faces of the adolescents pictured.
